My name is Kaan, the owner of Avion Wall Design.
Today, I received an email from Etsy’s Trust & Safety team, and it deeply upset me, I would like to briefly explain the situation to you.
On August 21st, while reviewing my products, I noticed in the "You May Also Like" section of my Wavy Iridescent Lamp listing that my design had been copied, using my own photos, description and title. I was in complete shock at the time. I immediately reached out to Live Chat to ask for guidance on how to proceed with this issue. I thoroughly explained the situation, expressing my concerns, and made it clear that the design and photos were entirely mine, taken in my own home. (In the photos, you can even see snow globes from my personal collection, gathered during various trips. and also They even completely copied and stole the description of my product. Even though that shop is located in USA, they copied from my description that I would send an EU plug to USA plug for orders coming from United States.) Unfortunately, I was informed that the matter could not be escalated and that my only option was to report that shop.
After this live chat conversation,I sent a message to that seller, stating that the product belongs to me, the photos, including the description and title, and asking him to remove the product. However, he did not respond. I immediately report and briefly explained my concerns and the situation in the "description" section. However, after some time passed with no changes, I began to research what other actions I could take. Through my research, I learned that the most effective solution would be to file a DMCA Takedown, which I promptly did on September 16th
Since September 16th, my takedown request has been processing. Three days ago, Etsy’s requested from DMCA, proof of authorized to act from me to confirm my identity, which I provided, including my signature, name, and company details.
Instead of the copied listing being removed, however, my own product was deactivated. This has left me deeply saddened..
I have been an Etsy seller since 2022 and have always provided the best service to my art collectors. The reviews on my store reflect the happiness and satisfaction of my customers, with many 5-star reviews specifically for this product. For instance, I received a 5-star review from a collector on December 22nd 2023 regarding this very lamp. The shop that copied my design and photos listed the product on September 8th, clearly much later than my own original listing.
All of my designs are incredibly valuable and special to me, which is why I take such pride in sharing my work with others. It’s heartbreaking to see my own listing removed, while the copied version remains active. I can easily prove that the design drafts and photos were taken by me, in my own home and also dates of original pictures ( Pictures taken in my home at October 21, 2023)
I hope you understand my distress and will assist me in reactivate my listing. It would mean the world to me to continue sharing my art with people around the globe through Etsy. I kindly request your support in having my listing reactivated.
