I am very happy to report that I am now CPSIA compliant. I had a third party approved lab do the testing. Besides the cost, it was all relatively painless.
I don't think i was being ugly .....you have not said where ...when ...how ...or why ...all you have come back and said is "Were all being ugly and mean" Its not that were being mean its that you posted in a very PUBLIC FORUM about a subect tht is very near and dear to ost all of us who sell children's itmes and then opted out of your own conversation! Funny .....
To be graphic, I think that Bitty may be full of "crap". If you read the required testing requirements for phthalate testing you grind down the product and then do all kinds of chemical stuff to it, then test the distilates. You can't send one red Swars and expect to have all test "compliant". Every one of her products would seem to fall under the total lead, the lead paint, and the phthalates testing, so what the heck would she have to sell?????
My understanding of the children's products are that they have to be "primarily" for 12 and under for them to need to be tested. I would think that most of your pendants are for anyone, not primarily for the 12 and under group. At least that's how I have read it.
As I look at her listings I notice that it states that it's not intended for children. I thought this whole issue was for sellers that sold items to children 12 and under. I'm confused now.
I'm just so sick about this whole darn thing. This morning I"ve been reading about "another save the public" law. HR875 the Food Safety Modernization Act. You got it, it sets up another entire realm of gov. peeps to control all farms, food producers even to animal food producers, sets up $1million fines, and even allows "citizen civil reporting" , And another whole set of "certified labs". This is how we are creating jobs. All government jobs. Those that are selling food products on Etsy are falling under this act. Cpsia was only the beginning.
FayeMaloneDesigns things sure are getting scary. Talk about big brother taking control of our lives. You're absolutely right. CPSIA was only the beginning.
FayeMalone and LittlePeanut, I'm with you on it all! The part that is the most disturbing is the "citizen civil reporting." I grew up in the 80s/Cold War and remember learning about the Soviet system with the neighborhood party people turning in their neighbors. Never thought it would happen here. I don't know many people from either side of the political spectrum who wants the government to have too much involvement in their day-to-day lives.
Reading through this thread I do see where Bitty got the negativity, but to take it so personally when this issue is high profile bothers me. Obviously, she doesn't want to share her expertise or she would have answered some questions. Here I thought I might be able to glean some further information.
Ha ha ha ha... maybe the joke was on us? If her method of compliance was to add the statement to all of her listings that they are not meant for children under 12?
I really would appreciate it if the OP would give us some more information please? I see that you have this tagline in your shop FP - Custom, bulk & wholesale orders are welcome. CPSIA compliant. I just see the warning in your listings about small parts - not for children. I understand this has to do with the small parts notifications needed - so was your testing for lead and phalates (sp?)? Was it XRF or lab tested? And so you now have certs for a wholesaler or buyer? Or do you have certs from manufacturers of products you use? More information please?

Believe me, I totally understand the impact of this law and all of it's ramifications. I own a children's boutique as well, so I have seen it from both sides. It is complicated, but if you really look at it, the government didn't sit down to write it with the intention of screwing anyone. It may be the result, but not the intention. With that said, they are working toward clarifing the confusion and publishing documents that will help us understand how to move forward.
If you don't throw you hands up in the air and try to work through it, make some good faith efforts, document your process . . . you will find a way to comply.
Are you going to share how you complied? Wouldnt that be supporting the artisan community that you are a part of? It seems like alot of people want to know first hand what you went though.. what the process was .. what the cost.. where you went etc. you can't share that info to help others? Especially since you own a boutique? Just wondering?
I'm sorry that you feel attacked, bitty. To me, it just seemed like everybody asked questions to further clarify how you were able to become 100% compliant so quickly. I really don't think any of the singular posts were attacking you. It's just that everybody is interested and worried, and taken together it probably is a bit overwhelming. I really would love to know more, if you would be kind enough to share.

Look i am not a very mean ...nasty... or negaitive person far be it for me to try and sooth your ego just a bit because that Ain't gonna happen not here ....i have 5 kids and if i need to touch someone's heart or sooth some ego's today it will be left for them .....
What really EERKS me is the fact that you hop in here with your "i am compliant yay" and then when the tough questions get asked your like "oh your all so mean i just am not willing to share" well then don't sit on yoru high and mighty thrown and come in a very public forum with a very TOUCHY SUBJECT and respond ....just Seriously ...UGH....
We are all annnoyed at you...your darn tootin' and we have every right too be you came in an open forum and said point blank that swar. crystals were tested and passed ....so all these months that all of this stress that we all have felt has been in false ..just a huge hoax...CORRECT...well shute we should all just call cpsia and let them know that in fact they had it wrong all along....in fact swar. crystals do not contain lead whatsoever they are 100% tested and in complinace with the new law!
We all know the law as for MONTHS AND MONTHS we have studied and debated and watched and read it time and time again and oh and written letters and called and cried and yelled....i am glad that you think you found this huge loop hole by "TAGGING your shop not INTENDED for children under 12" we should all just start following your advice and jump on board and write we are all compliant and make sure that we write in every single listing that we are compliant tested approved and safe for small children and FINGERS CROSSED cpsia will just turn a blind eye!
