My Congressman finally responds....what do you think of the response?

Here is what I received today.....

"I appreciate hearing your comments regarding the Consumer Product Safety Improvement Act (CPSIA). I was a proud co-sponsor of this legislation.
This past year, Iowa's families were frightened by story after story of dangerous products that had to be recalled. There were 472 product recalls last year alone. From pet food to kitchen appliances, consumers were often left wondering whether the products they were using everyday were safe.
One of the most upsetting occurrences was the news of toxic toys that contained hazardous lead paint. More than 20 million toys were recalled last year due to lead paint.

As you know, in order to better protect consumers, Congress passed the CPSIA to provide new safety and accountability standards for manufactured goods. It also authorized a much needed infusion of resources to the Consumer Product Safety Commission (CPSC), the federal agency responsible for protecting American consumers. Recent recalls have made it painfully clear that the CPSC is grossly underfunded and understaffed. The bill we passed will ensure the CPSC can beef up its staff and provide the oversight Americans expect.

One important safety provision included in the bill is the requirement of third-party testing and certification for children's products. I believe this is a crucial provision. It is vital that Americans know the products they are purchasing, especially for their children, are safe. I also recognize that this testing process may create a burden for small manufacturers. For that reason, I am pleased the law provides an exemption for crafters who only make one copy of each item. Furthermore, I understand the Commission is examining an additional exemption for products made from untreated wood or natural fibers. I am also hopeful that as more testing companies are founded, the costs of meeting the law's requirements will come down. 
I do not, however, favor a blanket exemption for all small businesses.
Many recalls in the past have come from small manufacturers, and it is imperative that parents know that a product does not contain lead, no matter who manufactured it. While I am extremely sympathetic that this requirement may be a significant burden for many small businesses, I believe our children's health and safety must come first and testing is a necessary safeguard.

I hadn't heard this...I make one of a kind clothing..is this good news? I can hardly believe his comments??????

Layette, this letter goes right along with the communications I have had with my Congressman's office. They are of the same mindset.

What they don't seem to understand is the difference between the costs associated with testing to protect the child, and killing small businesses thus not allowing parents to put food on the child's plate!

There has to be a better middle ground.

OOAK IS safe. OOAK is also open to interpretation. So, for instance, I make a bib but I have an additional 2 yards of fabric I"d like to use. I'll simply change the backing fabric....OR...the position of the pattern on hte fabric. That's MY interpretation and I have no intention of closing up shop

i think the "small business" that your congressman refers to is still many times bigger than most stores here in etsy...

Splendid spin doctor----what he meant to say is:

My cronies and I stand to make a good deal of money from this regulation. The gains that we are able to yield from having purchased shares in the companies which are now "approved testing sites" alone will set us all up quite nicely. Add into that the lovely cash crop that will be broken off to us behind the scenes in the form of "gifts" by the large toy manufacturers who will mostly benefit from this travesty and you have the best moneymaking scheme...er..law since the days before the trusts were broken up.

Someone else was given this same response on another thread a few days ago...

I would LOVE to see that in writing somewhere. My congressman told me just the opposite. I like this answer better, lol!

i sgree this sounds promising but what EXACTLY does ooak mean?what if you make 1 style of bib but everyone of them uses a different fabric?are each one then one of a kind or is the bib pattern itself one of a kind? and all those bibs not?does this make sense.you are making maybe hundreds of the same 'shape' bib but using different materials.i would love to go back to making some of my children oreinted items.

Yup that would be Tom Harkin, and evidently he doesn't know what he's talking about.

There is no exemption for ooak items. And the small business he's talking about is defined as a business with less than 500 employees. Not exactly an etsy shop, eh?

Just researching Tom Larkin and found it absolutely hilarious that he serves on the U.S. Senate Committee on Small Business and Entrepreneurship. What a joke!

If you're making children's things from fabric, can you get a certificate when you buy the fabric that it has already been tested? That would certainly make it easier.

On the other hand, I have seen baby toys for sale on etsy that have buttons just handsewn on, which is a big no-no as babies put everything in their mouths.
