Whoa. The Phthalate is retroactive because of Barbara Boxer

Know your enemies:
The Commission, Nancy Nord and that other person, actually tried to help businesses out by ruling that the Phthalates ban was NOT retroactive. In a letter issued November 17th they said that their reading of the bill indicated that products untested for Phthalates could not be manufactured after February tenth, but inventory could still be sold.

In comes Barbara Boxer, Democrat from California (I forget whether she's a Senator or CongressCritter, which is sad, because she used to represent me), who, with Diane Feinstein, *wrote this very provision.*

She had a fit and said it certainly was her intent to apply the ban to existing inventory, and the Commission was guilty of a gross misrepresentation of the bill ('blatantly incorrect'). Is it any wonder they seem to move slowly when the same Congress that publicly criticizes them for not acting undermines them when they do act?

On NOvember 4th, the Natural Resources and Defense Council and Public Citizen Filed a Complaint AGAINST the CPSC demanding that inventory NOT BE PERMITTED to be sold after February 10th.

Stuff like this is why Kathleen of the Fashion Incubator calls the letter Waxman and Rush (who wrote the law) wrote to the Commission a 'bait and switch.'
