Yesterday I visited a shop for the first time in a couple of years and about an hour later I received one of their marketing emails. How is this possible? I had to physically unsubscribe....

 

Was not an Etsy email, it was from their www.website.com

If they are farming email addresses from Etsy, they must provide notice of how they are using your information in their shop's privacy policy statement.

What is shocking to me is all of the shops that I see on Etsy that have no privacy policy. Yes, Etsy has a policy but that only applies to how Etsy uses information. It in no way tells you how individual shops are using your information. Shops in the US are legally required to post a privacy policy.

And I just now located what Etsy says about protecting personal information:

b. Privacy and Protecting Personal Information

You are responsible for protecting members’ personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use Etsy user information. These laws may require that you post and comply with your own privacy policy, which must be accessible to Etsy users with whom you interact.

It is against Etsy policy to harvest emails. People, Buyers, Shop owners, Guests etc...must all opt in. 

 

I opted out after receiving the email and it finally stopped. 

 

I have only signed up with two email lists from Etsy shops in the past 7 years and I KNOW what offers those were.

 

I do not have to ask them. I have bought from their shop years ago...... and this was (their outside of Etsy) marketing weekly email that I never opted in for. I thought that was against Etsy TOS as a shop seller.

It is amazing how many shop owners seem to think that anti-SPAM laws don't apply to them.
