I have another shop that is not the one that wrote this post. Today I logged in and got the message "You may be unable to access your account". I don't know how to file an appeal. I used this account to chat with support and got the answer that my shop was banned because it was a fake account. While my shop is real. All my information is valid. I think there is a mistake. Because I am also selling on other platforms with similar images.
Can someone help me?
My shop is open again. Thanks everyone.
I think I was reported by someone who impersonated my brand because a few days ago I DMCA'd a scam website that used my image to scam.
Fake account? What does that mean?
probably selling League of Legends stuff there too
I don't understand what they mean either. Or maybe my store was sabotaged by someone and reported falsely.
I'm asking about another shop of mine. There is no "trademark" keyword. But the shop's image can suggest the Friday the 13th brand. But my photos are not close to the original movie.
If you are using the name or words, or a likeness image, that can be enough. If you were reported, then this could be the reason your shop was closed down.
All you can do it try and appeal
How can I appeal when I can't log into ETSY?
More info: I found a website posting my photo and scamming customers. I DMCA'd the website, and it stopped working. I wonder if someone reported my shop?
I received an email they said:
"Hello,
Thank you for contacting Etsy Member Services. If your account is suspended, this message provides more information about your account status below."
How can I submit an appeal?
Were you selling trademarking infringing listings in that shop too?
Yes. But I didn't use the keyword "trademark" and the image is not 100% the same as the original. I think if there was a trademark issue I would have been reported by the owner, and I would have received an email to deactivate the listing. But not here. I think today is the day the ETSY Bot checks
@TurnMeLegend: Trademark infringements and copyright infringements are subject to different laws and take down rules. Etsy will always act to protect itself so it does not lose its safe harbor status.
"... the image is not 100% the same as the original ..." Immaterial. If you draw a rodent and the average person says that it looks like Mickey Mouse you are infringing, even if you never heard of or saw Mickey.
If you design a portrait and call it a 'League of Legends' item you are implying that it was made by or authorized by the trademark owner. If you do not have licensing you could be considered a counterfeiter. If you are using someone else's picture as the primary image replacing the face may not be enough to avoid copyright infringement claims. Often these situations can only be resolved in a courtroom.
You may want to discuss your business plan with a qualified intellectual property attorney before one of the intellectual property owner's attorney comes knocking at your door.
@BagmakerSupply But my shop has been reopened twice. The previous two times were both suspended in error. And I have not had any new activities, like adding new listings, editing old listings, Just selling and shipping as usual. But this time is different.
@TurnMeLegend: Just because your shop may have been suspended in error in the past it does not automatically follow that this time is also in error, although of course it could be.
"... I have not had any new activities ..." False positives aside, Etsy let a lot of violations slide for a very long time, and it is clear that Etsy has stepped up enforcement of the rules. Also the triggers that cause listing deactivations and shop suspensions are constantly evolving and changing. A sale will often trigger a check by a bot.
As to getting the cannot sign in issue resolved, have you seen https://help.etsy.com/hc/en-gb/articles/115015410188-I-Can-t-Sign-In-to-My-Account and followed the 'I Still Need Help' links?
@TurnMeLegend; You are not doing yourself any favors by not following Etsy's rules - for example the requirement that "you must list all the shops you run in the Public Profile section of each account." See https://help.etsy.com/hc/en-us/articles/360017604474-How-to-Open-a-Second-Shop-on-Etsy?segment=selli...
Etsy seems to be cracking down on technical violations and intellectual property owners are cracking down on infringements. You may want to make sure that all your shops and accounts are in compliance with Etsy rules and the law before starting an appeal.
Yes. I am also selling on other platforms
How to appeal.
i can't log in right now.
@TurnMeLegend You are in the forums which means you can get to HElp.
Is this a listing or entire shop? You need to file an appeal if it is your entire shop.
The problem is the previous takedowns are not removed from the other times. Etsy can then close down if they feel enough has happened. The number of times is up to them.
If you are doing as listed above, Etsy may consider the items counterfeit. Etsy can then remove the items without the need for the holder to file.
Just as in the shop you are posting from (which is incomplete and needs to be completed) there is a possibile issue with infringement with the princess listing. Disney may take exception as it is trademark dressing to use a trademarked Belle or Frog Princess, etc.
I'm not a lawyer but have researched copyright and trademark in my other job. I suggest getting legal advice on what you doing.
And why when i log in "You may be unable to access your account". instead of "your account is permanently suspended"?
Your current shop is trademark infringing
you cannot use the words
League of legends,
anywhere, titles, keywords, description, nowhere
If you don't understand that, than you probably had trademark words in your other shop too
What were you selling in the suspended shop?
My shop is open again. Thanks everyone.
