Hello, my name is G. Agarwal, owner of the shop name https://www.etsy.com/shop/silverstarjeweletsy We have 29,053 Sales record and running shop since 2018.
Since last 2 months, we are receiving emails from Etsy for Handmade Policy Violation. 2 days ago, my store was forcibly put on vacation mode for 28 days with a warning that it would be Permanently Banned after that. In last 2 months, we are trying everything and revised many listings if there is any issue. But we could not be sure about the exact reason for the warnings.
When we contacted Etsy, we received automated email saying "We’ve determined the items in your shop do not qualify to be sold on Etsy. Based on our research, the items listed in your shop are commercially available across many online venues and are commonly resold".
I agree. All my items are made by me with the help of smith. When you see my items, all the designs are simple designs and worn by women on daily basis. The items are not expensive, and anyone can afford them. They can be worn daily, and I don't make the designs that are worn only on special occasions. As the designs are simple, you may see some similarity on many other places. But all my items are made by me with the help of smith.
But after, we didn't receive any response from Etsy. Please help.
I would check to see if your photos are found on AliExpress, Temu and Shein. The Etsy bots may think that you are reselling. If they are found elsewhere you will have to file a DMCS notice with the company to have them removed and give the proof to Etsy.
I looked at some of your feedback, and a few of those images are popping up on Amazon, Aliexpress, and other shopping sites on the internet. You need to file reports with those websites if they are stealing your photos.
I was also under the impression that shops couldn't have "etsy" in the user name - has that changed?
https://www.etsy.com/uk/legal/
"For example, we don’t allow the use of the “Etsy” trademark as part of your shop or company name..."
@TinTeddy thank you
I thought Etsy prevented people from using "Etsy" in their user name - like they were forced to choose a different one before completing that part of the account creation.
Unfortunately, Etsy doesn't have an "Etsy zapper" in user or shop names. Lots of scammers have been recently signing up as "Etsy Helper" or whatever. Using the name Etsy is against the policies but people still do it until they are caught.
@FallenAngelBrass thanks! It seems like it would be an easy-ish thing to implement, kind of like the password creation process that warns you if you don't have the required number of characters, or correct amount of upper case/numbers/special characters etc.
I did not see the "smith" listed as a production partner.
Actually a "smith" is a trade designation. Smiths are typically metal workers. The OP does have another individual listed as a shop member.
Yeah, I saw that - I believe I would have named that person as the "smith" - it would be a lot more transparent.
I no longer have any clue how it works for all the wholesalers such as yourself here. As you say, you have been doing fine (even using etsy in your name)...all good. Now the bots are searching photos and changing things up dramatically. Since your items are commercially available on wholesale sites and you also sell on retail venues I don't know how you get around this issue. The rules for individuals vs. companies in the *handmade* category here have always been different.
I have done a reverse image search on a few of your items and while they are on other platforms being sold they appear to be under your brand name only. You need to point this out to etsy. Also I would take the time to reverse image search every product, cross reference it to every other place its being sold and hopefully it is under your brand, if not, file DMCA takedowns and send all this documentation to etsy. It may work to do on something like a excel spreadsheet, with columns as to where you are selling your jewelry under you brand and columns of where people are violation your copyrights, cross reference that with the DMCA takedowns, and don't forget to file the same takedowns with Google. It may help get your store back, and it will take lots of time, and you may not find everything? I was a former forensic accountant here in the USA and this made me good at documentation and research. Others may have more idea's about how to locate everything. Most times I find sites that steal from us don't use the same titles/seo that we do, which makes it more difficult to find.
Take "Etsy" out of your shop name before you ask Etsy to come in and help you. Using "Etsy" is not allowed.
