OMG, I could cry...this is so frustrating. Everyone knows how long it takes to work on a new listing. Last night I worked for TWO hours from start to finish on a listing to have it freeze while I was on "preview". Once it froze I would not dare click back and yet I had no options. I took the risk and refreshed the page...poof, it was gone. BTW, this is using both versions. So, today I worked long and hard on yet another listing and again, another two hours of work gone. This time I did not want to preview I just went ahead and published...so I thought, after paying for the listing that never showed up. It is nowhere to be found. This a new store, I'm working very diligently to complete it. This has happened on the app and on PC both new and old versions. Is anyone else having issues?
Check your deactivated listings.
If you were using a famous person's name without permission, it could have been pulled for IP theft.
Improper use of the "Swarovski" trademark can also cause take downs.
Thank you for your suggestions. I’ll give them a try.
I've been getting that red "there's been an error" banner when opening up listings to edit them. Even before I've even changed anything, just opening them gives me that error.
I'm sorry, though. I can just imagine how frustrating that is. Maybe do screenshots from now on during the process.
The error banner was another thing, as well.
I have learned the hard way to copy past titles, tags and descriptions into a word document in case
It is most likely not Etsy but your device. What browser are you using? It is possible a time out happened. Use the app, I would use a browser. Also a browser Etsy supports.
I would check deactivated. I noticed from some of your listings you are using iconic names and the word Swarvoski. To use the name I believe you have top apply for permission to use the name Swarvoski. They made that clear a year or two ago. It is possible Etsy has placed the items in deactivated.
I've never had to work on a listing any more that 30 minutes max so that is why I think ytour system timed out.
You bring up a very valid point about the timing out. I did check everything from drafts to deactivated. Thank you
Can one say 'Anna Wintour' ?
Not without her permission, no. I think it would be okay to describe them as similar to those that she wears, but to use her name in the title steps over the line.
Of course, not (without a permission).
Yet it comes as no surprise there are thousands of "'Anna Wintour'" listings here, including jewelry (some with her photos), POD t-shirts and even a Christmas tree ornament with fur collar. :))
I am not aware that we can’t. If out of curiosity you do a search on Etsy, using Anna Wintour, you’ll see pages upon pages of these necklaces. Same for those who have mentioned Swarovski.
I will try, as mentioned above, omitting those two terms and see what happens.
Personality rights, sometimes referred to as the right of publicity, are rights for an individual to control the commercial use of their identity, such as name, image, likeness, or other unequivocal identifiers. They are generally considered as property rights, rather than personal rights, and so the validity of personality rights of publicity may survive the death of the individual to varying degrees, depending on the jurisdiction.
No, you can't. If you suddenly became very famous overnight, these laws would stop me from slapping an image of you on a t-shirt or worse, and using your name in the listing. We all have control over the commercial use of our names, identifiers and likeness.
Homemade and handmade?
Can you be more specific?
@GraceAteliers: "... after paying for the listing that never showed up ..." There are many reports of (sometimes substantial) delays in listings appearing on the shop Home Page, in search, etc. Have you checked your listings page (under Active and Inactive in case Etsy deactivated it) to see if it is there?
As suggested, you should to include your licensing information (and disclaimers and attributions as may be required) for any trademarked and copyrighted names and images in your shop in the listing, otherwise buyers (and Etsy) may conclude they are counterfeits. Including the licensing information will show that you are not selling those items illegally.
How you word things also matters. If you are selling phone cases which you make, calling it "iPhone Case" implies that it was made by Apple and therefore is either a counterfeit item or you are reselling. "My Case for iPhone" may be all right but Apple can still come after you for using their trademark without permission (if you do not have a license), particularly if you do not include all the disclaimers and attributions.
@BagmakerSupply Thank you for all of your suggestions. I will take them all into consideration.
I am grateful for all of the suggestions, thank you! I must share that I just did, out of my own curiosity, a Google search using: “Anna Wintour Necklace”. It so happens that the results show no other than those same AW Necklaces being advertised by Etsy…rows of them. Etsy is also advertising “Anna Wintour Jewelry”
YES, there are thousands of illegal listings on Etsy.
Just look up "Disney" anything. Disney doesn't grant crafter's licenses.
Or "used" - there are a lot of used underwear that you can choose how long they've been worn, and what body fluids are on them. Some come with custom p0rn.
NEVER go by what others are doing.
@GraceAteliers ~ Even though there are "rows of them" listed does NOT mean that any of them are listed legally. The suggestion is always going to be to research before you list. Just because others are doing something does not mean it is right. You can Google search whether you are allowed to use her name or the name of the crystal with or without permission. Most (if not all) famous names, brands, TV show/Movie names and characters etc. are Trademarked or Copywrited and are extremely expensive to obtain permission.
