Hi everyone,
My name is Lisa, I'm the owner, maker and designer at my handmade in Italy jewelry brand, selling on Etsy since 2013. I only make and sell my original products with photos taken by me.
Two of my best selling listings have been removed in the past months due to “Etsy Creativity Standard’s Violation”.
Please note that:
I’m sure that the listing has been removed for some sort of mistake, probably by an automated system, but after opening several tickets and sending multiple emails, I never got a reply and it's been over a month now. The tickets get closed almost immediately and noone reached out to solve this.
I’ve provided via email and support request all possible proof including a Counter Notice, sending them a video of me making the items, screenshots of the first time published, selfie + ID to demonstrate I’m the one in the photos, and as well as unpublished and unedited photos.
I’ve recently discovered that Aliexpress and Alibaba are using my photos with MY face and MY designs to promote cheaper copied versions of my works.
Luckly I managed to take them down as Aliexpress recognized me as the rightful owner of the photos and designs, but STILL Etsy is not responding to me nor they turned my listings active again. I've even started a legal action against Aliexpress and Alibaba for how serious I am on this matter.
It’s really devastating and heartbreaking to live all this, when you just want to dedicate your time in creative processes and in making the customers happy.
Would you be so kind as to help me out with this? I really don’t know what to do anymore.
Lisa
Provide etsy with the takedown you used against Aliexpress
Thank you, do you mean the claim statement IPR? I've provided them all proof of my legitimacy but they just keep closing my support requests. I've send all materials to different email addresses and all ended closed
I'm so sorry to hear that I can just imagine how can be frustrating. I hope that someone can help you.
Your products are amazing
Thank you, I appreciate it! Yes, it's unfortunately really tough to handle but I hope I can find some solution and suggestions here
how horrible. Good God
it looks like a nightmare, the first horrible thing was to discover I was being badly copied, and then it simply got worst with Etsy not providing support. Thanks for your kindness, I appreciate it!
@FabioMcMustache Maybe he can help you? I noticed he seems to have solved similar cases!
thanks, I hope so!
perhaps request a call back from Etsy, and ask them to escalate the matter. (not sure how much good this will do, i've escalated my open case twice now, and it's past 45 days waiting... sigh)
callback feature:

Omg 45 days! I'm so sorry for you, but I hope you are close to a resolution!
I've tried the callback, but unfortunately I'm from Italy and for some system bug (already reported to the customer support) I'm only allowed to write 7 numbers while phone numbers in Italy are all of 10 numbers :')
Did you file all of the evidence including the DMCA takedowns when you first appealed? Or did you submit that evidence subsequently?
It's generally best to stick to one ticket, unless previous ones were closed. You can check to see if they are open here: https://help.etsy.com/hc/en-gb/requests?segment=selling
Thanks for your help! I currently have only one opened ticked regarding the first removed listing, but still without reply. It's good to know that it's best to stick to one, the listings on Aliexpress were unfortunately taken down after my reply to that ticket, so I sent them the DMCA takedown after, on a separate ticket (which ended up being closed without reply). Do you happen to know that if I reply to the open ticket I lose the priority in queue?
@MyrilJewels Replying to the ticket should not hurt. I would add that evidence immediately.
I don't think you can tell people to buy cheaper on your website. Etsy will look at this as fee avoidance if you're selling the same items on your site.
Thanks for the advice, I didn't know it!
What ever happened here @myriljewels this same thing just happened exactly to me and I lost star seller badge and have a thread going getting good information but no responses from ETSY?
