Listings being deactivated by Etsy

Hello,

 

I started changing my listings a week ago and they started getting deactivated by Etsy. First I stopped some variations and changed the shipping profile to 2 listings and a few days later I realized that they have been deactivated. I received a generic 'no reply' e-mail stating that my items are unauthorized or a potential counterfeit. I wrote the support and am still waiting for a response (it's been 7 days now...) I thought it was because of the new shipping profile, but the other 2 listings that I made the same changes to we not deactivated. Yesterday I tried to stop some variations on other 2 listings and they also got deactivated immediately. I opened a chat with the support but they told me that they cannot help me and I have to wait for the other team to respond. Today I changed a picture and the SKU of another listing and 'Surprise!' it also got deactivated. Now 5 of my bestsellers are gone and I am afraid to make any further changes to my listings.

Does anybody else have this problem? Do you know how I can reach someone from Etsy support who can help me?

I just read another post recently from another shop that was having the same problem. It took 9 days for someone at Etsy to get back with them and reactivate the listings. They stated that no explanation was given as to why the listings got deactivated. I'm so sorry this has happened to you, yet another reason why Etsy is failing miserably with it's "customer service". I hope your able to get it sorted out soon.

Is the artwork your personal illustrations or are they purchased somewhere?  Is that seller the artist?  Is there a commercial license? If it is all your own work you need to get in touch with etsy to correct it. That many removals and your shop is in jeopardy of closure. If they are not your illustrations and purchased clip art you need to do some digging to see if the seller who sold them to you had the right to do so.

Is there a company mentioned in the letter? Did you hand draw all the pictures yourself. Is there a company that uses very similar drawing on items like yours? If there is a company mentioned, you need to work it out with them. If you hand draw all the pictures yourself, that's a start! If you did not, if you bought them then they have been illegally sold to you. IF there is a company who uses similar drawings on items like yours then you need to follow their legal trail to see what they have protected both trademark and copyright. 

Etsy takes their time replying. I'm not sure why you changing anything in the listing would trigger the removal. Are you adding something that a bot is picking up like the word ivory or amber? Is there anything in the listings you are changing about Cuba? Those are major trigger words. Those will cause bots to immediately remove them. If there was counterfeit claim filed, then you need to prove you are not counterfeiting the items. 

Do you print everything yourself? Or do you use a production partner? If you use a production partner you need to disclose them. Again, I don't think that would trigger a bot removal but you have asked Etsy to come to your store... so I recommend not giving them something to find.

I see at least four other shops selling the same thing, so I would imagine that would be part of the problem. It would seem like a licensing issue maybe and not handmade?

Some of the clipart I use is mine and some I have bought (all licenses have been payed) and I don't add anything new to the listings, just remove some parts of the description and variations, because I don't want to sell them anymore.

I just tried to renew a couple of old expired listings with the new shipping profile and new variations and both got immediately deactivated. And I don't even receive emails about this anymore.

If you bought the clipart, it may not have been legally sold. This is not 100% certain, just a possible answer. If you search Mickey clip art.... all of that is illegal. Just because it is being sold does not mean the seller has the right to sell it.

I am saying just because you paid a license doesn't mean they could legally sell you one. If they ripped off someone else's art they would have no issues offering worthless licenses. I have had someone steal my art and sell it as Clipart. I have seen sellers here swear they bought a license on etsy to sell their Disney merchandise. You need to research your Clipart sellers.  If they are not the original artists they can't sell license on another's work.

@MariAngShop -- Since you do not have a license from the NFL (et al), you will need to remove their various team names from your listings ... otherwise, you are actually infringing on the NFL's intellectual rights, and your items are classified as counterfeits!  Read Etsy TOU, specifically about their Intellectual Property Policy ... it just might save your shop!

OK, if someone is reporting my shop, the listings would not disappear right after I click on the 'Publish' button. I have seen infringement cases and the email I received is not the same.

Etsy has beefed up its deactivation of "counterfeit" items. It seems to be triggered by renewing or republishing. 

Were any of your deactivated items of questionable IP?

Edit: Oh, I see. No, none of the items were, that's just what it says in the generic mail that I got the first few times. I guess that they have at least fixed the email, since today I already have 3 deactivated listings and no emails

As I see in answers below, questionable IP—actually illegal IP—is the use of Friends (even the font), Chanel, Dior, etc.

@MariAngShop  Looking at your current listings, you have "Dior", "Chanel", etc... incorporated into the artwork.  That is infringement.

Was it the wine labels perhaps?

Etsy probably have bots that pick up keywords for prohibited items and it gets triggered when you publish the listings. It will probably also happen if you make a sale and the listing gets relisted.

No, it was sisters and roommates prints. One of the listings has over 250 sales and the other ones more than 50 each, so this is something new. I tried to copy a listing and publish it as new and so far all of these ones are live, even though I made all the same changes (description, variations and shipping profile)

Okay. Here's another idea - you have a shopping bag illustration with DIOR and CHANEL logos. I wonder if Etsy are using only recognition software to read text on images and that triggered the bots.

ETA: Also just spotted Coke and Corona bottles. You might have to lose those options.

You have a "Roomies" print where the font is just like that used for the Friends TV series.  Did you mention Friends?  The font may be copyright too.

That explains it. Based on what happened to me recently and now l see this has happened to you, I think Etsy has turned their bots loose just very recently.

@EliseCharminDBeads if Pandora did not report it, they will. They got us back in 2011 or 2012 for it. If you put a non-Pandora brand bead on their Pandora bracelet it voids the warranty. By saying it fixes Pandora, you are misleading people to believe it is a Pandora bead (their opinion). They allowed me to relist when I took the word Pandora out of everything- tags, title, description.
