My listing was removed on behalf of the company that owns Hello Kitty for using their intellectual property. Problem is, I've literally never used it. I'm a star seller so I didn't get a payment reserve, but it was my main listing and I'd like to get it back. Posting here because I can't get ahold of Etsy. I emailed them explaining the situation, but they replied that they couldn't relist it because of the rule I apparently broke. Again, never used Hello Kitty stuff. Of course I could make an identical listing, but this one was in multiple carts and had been favorite by tons of people.
What rule did they say you broke?
They claimed I was using their intellectual property.
By doing what? Using their name or images or ????
Just a side note: do you use official licensed patches on your items or do you make them yourself?
do you know what infringing on a companys intellectual property means?
Again, I’ve literally never done anything Hello Kitty related. This is categorically an error.
@FowlVests Then counter file and dispute their take down notice.
Etsy will not speak with you about trademark issues... if that is what it was.
Sanrio owns 400 copyright/trademarks including Hello Kitty. Could it be that it wasn't Hello Kitty, but maybe some other patch or embellishment that you used? Just guessing.
Trademark or copyright? And specifically Hello Kitty or just something owned by the same company? The item is customizable - did a customer send you something Hello Kitty and show it in their review photo?
I am looking at the cache & don't see anything, but I am not a Hello Kitty or Sanrio aficionado. This means you might have shown up in a search for a term you never used.
I do see possible issues with the bands, though, so this may not be worth pursuing legally (which is the only remedy you have, when a big company comes after you.)
You need to Google 'Sanrio characters' and then see if there's anything there which looks familiar. It might be the design (copyright) or the name (trademark).
Would it be possible to contact Sanrio and ask them what the issue is? It's hard to avoid something when you have no idea what it is.
I looked at a jacket you have
in the tags you have
Judas Priest
and
Levi's
on the picture itself, you have labels with "Sex Pistols", Pennywise, Circle Jerks and a few others,
I'm not sure you understand about IP infringement

You sold something listed as a misprint girly skull (the title cuts off there). If I search specifically for "hello kitty crossbones skull" I see search results with the same exact character/design/logo as the one you'd sold. So at the very least you've sold something in the past that is in some way relating to hello kitty based on my results. Was the item that was removed similar to or the same skull with heart eyes and a bow? This may be a character owned by the owners of hello kitty.
You need to approach the holder and explain the situation. If they agreed you did not transgress then ask them to contact Etsy with an okay to relist.
If Etsy took down because they suspect counterfeit that is a different issue.
