Hello everyone. I opened my shop about a month ago. I still haven't had any sales. I uploaded a new item today. I got a notification from my printer provider that Etsy removed the listing. I checked my email. There weren't any emails from Etsy. I checked my spam, trash, social, and promotions boxes as well. I emailed them. Sadly, they only have two options when you contact them. One option for the removal is due to copyright infringement. The other is for Etsy violation. There should be a third option that says you don't know why. It couldn't be infringement because I own the rights to the design. It is my own creation. I checked all tags and keywords and none are trademarked. I have the same design on a T-shirt. I put the same design on the hoodie I was trying to upload today. Same design, but two different garment style. I have seen many shop owners using the same design on different items. This is the only thing that would make sense, but since Etsy never sent an email stating the reason for listing removal; I can't solve a problem if I don't know what the issue is. After I contacted them, they sent the generic email response that everyone gets. It is frustrating not being able to get someone on chat or phone. Even email would be great. If it was an error on my part, It would have been nice to get an email with the explanation, so I could be given the opportunity to fix it. But if it is their error, they should also send an email explaining the situation. There should be someone who people can talk to.
Etsy can be a great platform, but their customer service really needs an upgrade. Is there anyone who could give me some guidance as to how I can contact Etsy and speak with someone? I want to resolve this issue as soon as possible. Thank you and I hope everyone is doing well!
Look in your inactive listings and see if it is there, sometimes there is a note. I have had listings removed by the AI for the word "amber", which popped back up after I changed it to "topaz".
"I have seen many shop owners using the same design on different items."
If you own the design and it's your creation, why would other shop owners be using the same design? Wouldnt you them go after them for copyright?
As far as contacting Etsy, someone may jump in with links and more information.
She is saying that other shops are using their own design on multiple items.
If it was a problem with the design why is only one garment removed?
I suppose one could interpret that in two different ways. I understood it as it was the same design (hers) other shops were using. Others could interpret it as other sellers using the same design of their own on two different garments.
Either way, just because one is picked up in a sweep or by a bot, it doesn't mean everything will be.
When looking myself, nothing stood out to me (as far as pictures are concerned) nothing screamed copyright or trademark.
And my goodness, if I don't correct my typo, I'll go bonkers...
*Wouldn't you then go after them for copyright?*
Lol done
Hi! I think I didn't explain correctly. I do apologize if my comment didn't make sense. My listing were removed. The designs are mine. I contacted Etsy via chat yesterday at 6 am. The orioles has been resolved and now my hoodies are showing up in my shop. It must've been an AI problem, but I am happy to have my listing showing. I knew I hadn't violated Etsy policy. Since I own the rights to the design on my hopdies, I knew I wasn't infringing on anyone's rights. But after a lot of running around and chasing Etsy support, the problem was resolved in my favor. Thank you for your comment.
Did you have kids sizes and a drawstring? Etsy has been removing kids pajamas, hoodies, etc with drawstrings or something like that.
It is probably that it was a hoodie if you offer kids sizes..or a glitch if you do not.
Your about page is a good place to show how you create your designs.
Hoodie if you had sizes for children is not allowed if it has a drawstring. Only hoodies with zippers allowed for children In that case, Etsy can remove as it is a prohibited item.
Deactivated will have a red banner across it. Check spam file for emails too.
@RavenNightlockDesign : "It couldn't be infringement because I own the rights to the design. It is my own creation." Is the actual art your creation or just how it is used? And just because you created it does not automatically mean that there is no copyright and / or trademark infringement. One can't draw Mickey Mouse from scratch and claim no infringement. One can't even legally sell a drawing of a mouse that everyone who looks at it thinks it is Mickey Mouse, even if the artist claims it is not.
"I have seen many shop owners using the same design on different items." This is in conflict with your previous statement. Who is infringing on whom? If you hold the copyright have you filed DCMA take downs to protect your rights?
The design was created from scratch. It is an original art design of the Cubaris SP Isopod Rubber Ducky species. I also have the same design in one of the T-shirts I have for sale. That listing is still active. Keywords are not trademarked since I did the TESS search. So there is no copyright infringement on any other design. My design is copyrighted, which means, I own all the rights to that design. I don't know if Etsy deactivated the hoodie listing because it has the same design on the T-shirt that I have for sale. The listing has the same design, but one is a hoodie and the other is a short sleeve- tee. I am aware of copyright infringements. I am a photographer and I also like to draw, sketch, etc. I am very well aware that we are not allowed to put designs such as Disney, horror movie characters, etc. This is funny since there are hundreds of stores on Etsy that do not have a license to sell products that are copyrighted by Disney, Pixar, etc. I am trying to dispute the removal, but it is hard to know what I am disputing since Etsy never sent an email saying why the listing was removed. When you click on the "Why Etsy removed my listing" they only give you two choices: Copyright infringement or Etsy violation. If it was an Etsy violation, shouldn't the seller have the right to know which policy was violated? I still feel it is an error. Etsy is a great platform, but they have major issues with listing errors, deactivating accounts without giving a reason, and their customer service is not friendly or helpful. I hope this makes sense. I have a major migraine now from trying to deal with Etsy.
You actually DO have trademark infringement in your shop.
"Dog Mom" is protected.
Thank you for letting me know. It didn't show on the TESS website when I added the listing. I will update it. Thank you. But the one that I am talking about is the Cubaris SP Isopod Rubber Ducky species. I have the shirt listing active. Etsy didn't remove that. I uploaded the same design on a Hoodie. The design was created by me. I own the copyright to that design, which is also stated on the description. Etsy is a wonderful platform, but it really needs to fix their customer service. Thee fact that no email was sent to make you aware as to why the listing was removed is a problem. How do you fix something when you dint know the problem? Thanks for your feedback. It is greatly appreciated.
I just checked again. It seems that it is not active. Status says it was abandoned or responded late. I checked Dog Mom again on TESS. It doesn't show Dog Mom TM. There are 18 live/active results. The only one that is similar, but not the same is #Dog Mom. Dog Mom without the hash tag is not showing on live results on TESS. I will do further research, but it seems the one from the link you orivided is not an active TM. Again, I will do more research on this. Hope you have a wonderful day
@RavenNightlockDesign - If the hoodie had kids' sizing read this:
https://www.etsy.com/seller-handbook/article/product-safety-essentials-selling/1031449955598
No, it is a Unisex Adult Hoodie. It is listed as such on the description.
Without getting into a discussion of what is fair or right or if your listing should be deactivated, the fact that you are selling something else with the same design could simply mean the bot has not checked it yet, or it could mean that the second listing does not contain the same trigger that flagged the first one. If there are other shops selling similar items it often only means that they have not been caught yet.
Hi, the problem was resolved after I finally got to speak with someone in Customer support. They realized there is no violation of Etsy policy. There aren't any copyright infringements. My listing are finally showing. I appreciate everyone's comme to and assistance.
Hello everyone. The problem was resolved after I spoke to someone in customer service yesterday. As I had mentioned, I knew there weren't any Etsy violations. I knew there weren't anycopyright infringements. The designs are my own creations of a comedic series of designs of Isopods. The problem was resolved in my favor and my listings are finally showing. I appreciate everyone's help and input on this matter. I hope everyone is doing well and I wish you all the success you all deserve. Thank you!
Could you share with us how you managed to speak to someone in Customer service? I have not been able to get past circling over and over again with "Contact Us" and then getting the same generic email from Etsy that does absolutely nothing to address the issue and says to open another ticket, and here we go again.....
