Has the Infringement Portal Changed?

Hello!

I need some help as Etsy Legal isn't responding to my emails about this unfortunately.

There's a shop on Etsy which has stolen a load of my personalised designs. Many of the listings they've made are rip offs generated with AI, and a for a few listings they have actually gone so far as to take pieces of my actual artwork and use it in their own. They've also stolen pieces of my titles and descriptions so the copying is undeniable.

I have had issues with copying before and Etsy has generally taken them down swiftly once I report on the infringement portal. However Etsy keeps rejecting the reports I'm filing against this seller and I have no idea why.

The reports say missing or incorrect information on my property. For one of them, I am using the exact property I have used successfully for previous reports so I'm not sure why it suddenly is getting rejected?

Does anyone know of any changes being made to this process or bugs in the portal in general?

Thanks in advance! Feeling so disheartened with this one. I have tried reaching out to the seller and I'm getting a "sending failed" message. I usually do reach out to sellers first but I just didn't want to put myself through it with this one as I find the people who copy on here are impossible to deal with whatever approach you take - and now I can't message them anyway.

Etsy is being filled with these shops that are so clearly just using AI, clip art and stolen artwork and I am absolutely shocked that they aren't helping me here...

Re: Has the Infringement Portal Changed?

If they have stolen your photos, and used them as their photo, then you can report them for DCMA

bits of titles and descriptions are not copyrightable
Names, titles, short phrases and colours are not generally considered unique or substantial enough to be covered,

If they copy your design exactly, you can only report them for IP infringement, if you quote the design number you registered them with.

not sure how you go about proving the AI they used, used your art, in the generation, as, for a lot of your things, there are very similar designs and items elsewhere
