Can't send messages

I haven't been able to send messages from the shop manager for over 24 hours. 

 

I reached out to support, who promised the issue would be promptly fixed. Since then my support ticket has been marked as resolved without further action or comment. I still cannot send messages.

 

I sent subsequent messages and tickets to follow up, but they've been closed without comment. 

 

What's going on?

Did you send out multiple identical unsolicited messages to people?

 

Is 'Monopoly' trademarked?

It most certainly is.  

OP, restricted messaging is the least of your worries. 

  • Monopoly  and Monopoly Go are both trademarked to Hasbro.  They are very strict when it comes to others using their IP without license.
  • If these are genuine cards, they are not handmade, or vintage, or craft supplies,  so you can't sell them here on Etsy.
  • If you make them yourself, you can't sell them anywhere without risking the wrath of Hasbro's lawyers.  Is that really a solid basis on which to start a business?

As far as your messaging privileges go, you have had 4 sales, it is unlikely you have been muted for contacting those buyers, and you are not allowed to contact potential buyers without their invitation.  Etsy will probably make you wait a week or more before restoring your message privileges, IF they do at all.

Support may not be replying due to shop issues.  If you search the forums for "Monopoly", you'll find many shops have been closed down.  One example;

Monopoly and Monopoly Go aren’t yours to use. You’re probably on their radar if they shut your messaging capabilities off for sending unsolicited messages, which means they’ll shut you down eventually for your infringements.

most of those sellers put that in their shop name, then they come to the forum a few weeks later asking why their shop has been closed and their funds are being withheld

@MonopolyFans: "... haven't been able to send messages ..." Exactly what error message are you getting? It makes it easier to help you with that information.

As mentioned by others, you need to include the licensing information for all of the trademarked and copyrighted names and images in your shop in your listing, otherwise buyers (and Etsy) may conclude they are counterfeits. And a buyer could file a not as described case against you and both get their money back and keep the item. Including the licensing information will show that you are not selling those items illegally.

If you do not have permission, you should be much more concerned about the intellectual property owner showing up at your door with a court order to confiscate EVERYTHING that was used to create, manufacture, and or market the infringing items.

Not to mention the legal fees and fines that you could be liable for.

Also, we are not supposed to help shops that are breaking the law or Etsy rules.

Sending unsolicited messages to potential buyers is not allowed (it's called SPAM). Etsy have now removed that capability. It you need to contact a buyer then you can use their email address from the order.

That said and as other have pointed out, what you are selling constitutes a trademark infringement. You are basically selling counterfeit products and since the owners of the Monopoly trademark are active in reporting listings, it won't be long before your shop is suspended. There are no second chances. If you don't want to be permanently banned from ever having a shop on Etsy, I suggest you delete your listing and find something else to sell which does not violate the Etsy seller policies or intellectual property law. Also change your shop name.
