Toy stuffing licensing and labeling laws questions!

I posted this in the forums and hoping someone here may also be able to help! Okay...just starting my children's line (I have another shop where I make art dolls:), have gotten the cpsia stuff underway and am now trying to figure out state stuffing laws. I know that in PA, as long as you're selling online you do not need to register and from what I can figure out in OH you're exempt if you sell less than 100 a year, but for MA it seems that there is no exemptions from the laws I've read...however when I called the people there seemed unsure. It's $300 yearly...so I'm really really hoping there's an exemption in there :) Thanks!

Any inventory you have is considered an asset and counts towards whatever figure your state has in place (I believe the federal number is $400). So, all the raw materials, partially completed products and completed products you have are considered assets. It's almost impossible to stay under. You'll probably need to register.

Also, if you haven't already, stuffed animals are toys and will need to be tested by a CPSC accredited lab, regardless of whether they are made of exempt/complaint materials or not. The Handmade Toy Alliance would be of most help there: www.handmadetoyalliance.org.

Hi Carolyn,
Thanks for responding! I spoke to Neil and he basically said that I am exempt from testing using the materials I'm using under the new provisions. I am registered as a small batch manufacturer and will have appropriate tagging, ect. Not sure what you mean as far as assets? Does that have to do with stuffing laws?

Oh really? The shop name will be wonderandkind..I don't have it set up yet. I have another shop that is art dolls that I've posted with before which is 425sqftart-however these will be totally different then my art dolls :)

You know! It is strange because when I went to start my shop there wasn't even a place for my banner-it said to just start adding things to sell. I figured I was maybe in the test? I haven't gotten around to my avatar yet, but I will soon:)

Yeah, I'd say you're in one or many tests. Good luck, Each day can be a new surprise in what your shop looks like. It can even change during a single day. Don't drink while you're looking at your shop. You will swear you are going crazy!

Lol! Oh boy this outta be interesting ;) I really like the layout of my old shop...plus I'm trying to build a brand so to speak. I wonder how that'll work without the banner? I guess I'll find out soon enough! :)

Okay... So for anyone reading this...trying to figure it all out... I just received a call back from Mass. Dept of health and now this person said if I'm selling online I don't need to register. Although first he said I had to. So confusing and I just want to make sure I'm doing the right thing! Hopefully there will be more people to shed light on their experiences for this topic.
