STAY WAS DENIED!!!

http://www.cpsc.gov/library/foia/ballot/ballot09/nam.pdf

Round and round we go...CPSC says Congress has the authority, and Congress says CPSC has the authority.

Re: STAY WAS DENIED!!!

Now I'm totally confused. Denied by whom? I didn't realize the CPSC even had to *vote* on something they requested, anyway. Why would Nord vote *against* something that she asked for only a week ago?

What the F***?! I don't understand why no one can take responsibility! They both see the damage this is doing, yet both wash their hands of it!

Re: STAY WAS DENIED!!!

Okay- my understanding is that only Congress has the authority to "Stay" the law and congress has not done so. Am i reading this right?

Re: STAY WAS DENIED!!!

Wait, this is something different. This was to stay the actual lead limits, not the enforcement. Another group came in a couple days ago asking for a 185 day stay on the actual lead limit requirement.

So basically, Nord and Moore said we still have to comply with the lead limits.

Re: STAY WAS DENIED!!!

To clarify - the enforcement is still stayed, the limits are not.

I don't know if that was any clearer than before. LOL.

If I'm wrong in my interpretation, someone please correct me.

Re: STAY WAS DENIED!!!

The NAM request for a stay on the NEW lead requirements was denied. There IS a one year stay on the testing requirement, but your product still needs to meet the new lead and phthalate requirements.

Re: STAY WAS DENIED!!!

Yeah, what Sugar said. Our products still have to meet the lead limits, because they don't have the authority to change that. But the "proposed" stay of enforcement is still in effect.

Re: STAY WAS DENIED!!!

The stay on enforcement IS going into effect. The stay for the new law is denied.

Now read this: http://www.cpsc.gov/library/foia/foia09/brief/101lead.pdf

Notably, Item 5, top of page 4...exempting fabrics (woohoo!) and then page 5, bottom, going into page 6.

Re: STAY WAS DENIED!!!

Thank heavens! I thought that the 1 year stay was denied! Does anyone know of anything we could use to test products ourselves to make sure they are in compliance? Also, a while back they had said we could use all natural materials but without dyes. Has anyone heard any more on that?

Re: STAY WAS DENIED!!!

This "roller-coaster"ride is doing absolutely nothing for my mental AND physical well being.I wish they'd make up their minds, quit passing the buck and give us a straight answer already. The option to go back to Europe is becoming more and more attractive!
The big companies screw up,and the powers that be take it out on the little guy in an already screwed up economy, leaving us holding the bag!!!

Re: STAY WAS DENIED!!!

Sorry, I posted before i saw your link! I'm glad I can still make some things, but i guess i'll have to find a way to make my shoes differently since i use elastic and buttons to close them. What about onesies from gerber and American apparell? They have metal snaps. Does that mean I can no longer sell those?

Well said beenadolls! I wish they would come up with a
way to keep the kids safe without hurting small businesses.WE all want to provide safe products and comply but, we shouldn't be slapped on the hand for the wrongs of others.
