Sorry to say that the testing of all children's products under section 102 has not been repealed, which would take an act of Congress & the House of Represenatives to do. Though the CPSC has "promised" a stay of prosecution to the manufactures for certain items not being lead tested till Feb 2010, and given us a temporary list of materials exempt from lead testing. Some products, like anything with paint (even fabric paint), jewelry, and certain baby care items must be tested for lead as of right now. Also the is NO EXEMPTIONS either by using "safe" raw materials or postponed tested deadlines for the phthalate testing, breakability/choking/small parts testing, or the added labeling requirerments if the product you are producing falls into the categories that require these tests. Plus the CPSC has given power to each States' Attorney Generals to investigate & prosecute any manfacturer or seller of products that any GA feels are in violation of the CPSIA on their own, & as of right now I have not heard of any single GA that has come out directly saying they will honor the federal stay of lead testing.
PLEASE, please remember that the stay of lead testing and the exempt materials list can disappear at any moment with the appointment of the 3 new commitee members and chairperson.
