If you distribute an item after Feb. 10th, is it affected by the law?

I have a buyer who would like to make a purchase. I told her that I could not sell to her at this point since my order processing time would cause me to have to ship after Feb. 10th. The buyer told me the new law only applies to items "sold after Feb. 10th." It was my understanding that any item distributed after that date would be affected, even if it was sold a month before. Does anyone know???

yes, it's retroactive. Anything sitting on a store's shelves will have to be compliant on Feb. 10th.

After Aug 14th they will have to have been third party lab tested to insure compliance.

If you're certain that your items are safe (by whatever means you deem to be "reasonable testing") you can still sell after Feb 10. Though a shipment of a wholesale order will have to include General Compliance Certificates.

She shouldn't order more than she can sell by Aug 14 though, unless you're conducting 3rd party testing on your batch.

This is just a buyer wanting to buy a single item. She wants to purchase it now, but I might not be able to ship before Feb. 10th.
