I am SO confused!!

For my CPSIA labels I have:
my business name and contact info.
Care instructions
What the shirts are made of (cotton and polyester)
DOM
Batch # info

What do I need on my FTC labels? I read the FTC website info and I'm still confused. Where do I put the FTC label and what is supposed to go on it????????

So, if I knit hats with acrylic yarn, I don't need to have an FTC label, right?
And, if I knit hats for adults, I don't need to have an SPCIA label. Is that right?

I don't know what hole I've been hiding in, but I JUST found out about all this now. Kind of panicking.

Okay, maybe someone already asked this...but just to clarify: CPSIA labels are for items for children up to and including 12 years old. Are the FTC labels for everyone, or just for kids?

I have a somewhat longer label, with the information for both CPSIA and FTC on the front side. The CPSIA info is at the top, then a space, and then other information as required by the FTC. (I don't duplicate, though. The FTC label is mainly care and content.) That should satisfy both agencies, and I'm using those labels for now.

I don't think anyone will be thrown in jail or fined if you have all the information they request even if it is on one label. Good grief, they can't even figure out what is a child's product, for sure, they tell us "have a focus group"!!! Well, I think this forum is the next best thing to a focus group!

SO..... for hair clips, bows, etc. what I understand is that I need a CPSIA label, but not an FTC label - and this label can be on the product packing, since I can not attach it to the hair clip, reasonably. And I just need to keep track of the products I use certificates and do not have to have each clip I make individually tested at this point??
I am still a little unclear what exactly needs to go on my CPSIA label. If I attach it to the bow card, is this sufficient?
Also, I Do NOT need to do batch numbers/lots, etc?

Yes, You need a CPSIA label and all of that info. can go onto your clip card. It will need to have your business name, location, and website address so you can be found in case of a recall, etc.

I don't think you need batch numbers...
You will need to keep your GCC's on file...

You will also need a small parts/choking hazard warning on your clip card as well..

I think you may have a problem with your embellishments. ..Do you have GCC's for ALL of your buttons and embellishments? Also, it looks like you use plastic buttons on some clips...those will probably need testing certificates for phthalate levels....

SupplyPalooza - thanks for your response. I don't have GCCs on everything yet as I was just made aware of this this weekend. Must have had my head burried in the sand or something. But I have been busily contacting all my suppliers and am getting them in order.
On the plastic parts - I thought the phthalate testing wasn't required yet? Or am I confused? Either way, I have contacted that supplier as well....haven't heard anything yet. I suppose those items I can't get certs for I will just have to subsititute items that I can.
Since you seem quite knowledgable - do you know if on my fabric buttons since the metal housing is "not accessible to the touch" are they exempt because they are covered in fabric? I remember reading that somewhere, but now I can't remember where, or if it was fact or fiction?!

PS - to anyone curious, I contacted the brand of the rhinestones (acrylic gemstones) I use (which I purchase at Hobby Lobby) and asked them if they had certificates, and they emailed me the GCCs this morning - yippee! If anyone needs them , convo me and I'll forward them on!

I'm not 100% sure about the fabric buttons. Since the metal part is not accessible I THINK you are OK, but I would hate to give you the wrong info. Hopefully JewelryDesignsbyMe will chime in she knows a lot about the lead and phthalate info.

I'm pretty sure that you will need test results for phthalate levels as well....

Best to check the CPSIA website about phthalate info.

Currently, there are no labs certified to do the lead testing that I am aware of..... (like how stupid is this, demand testing on something that the protocols for testing haven't been written and the labs not certified!!) But that could happen anytime.

As to the covered buttons. I don't make bows, so I need to ask, has the shank been removed and you glue the button with the metal back directly to the clip, or is it sewn on? If it is sewn, could a child's finger or tongue possiblly touch the shank or the back of the button? If it can, it is accessible. You would need a lead content test from the manufacturer of the button to cover. They use different sized flexible probes to check for accessibility.

Could a small child pull the button loose from the clip? Is so you have a choking hazard and have that issue to deal with.

The button I use are actually "brads" so they attach by poking the prongs through the ribbon, then folding them back (think manilla envelope closure) - on top of this I secure them with glue, so the metal part is not accessible and the button could not really be pulled off unless you took the entire clip apart and even that would take a lot of work. I have screwed up clips before, tried to get those buttons off and ruined the clip trying. I have look at and checked my clips with these buttons and I don't feel like the metal part is accessible, but who knows?!

I am hoping these particular item would be considered exempt, I just don't know where to go for answers! Every case is so specific and the rules are confusing!

faye - did you mean there are no labs for the phthalate testing, or did I catch you right when you said there were no labs for lead testing?

Correct NO LABS FOR PHTHALATES.. Labs all over the world, especially China!! for testing for lead levels.

Thanks for posting your label info. I can't imagine why anyone would have a problem with all the info on one tag, even if it hasn't been approved yet. Seems like a waste of time, resources etc.
Good luck on your sales. I am going to do my tags like you, too. One tag and I'll take my chances. They have bigger fish to fry!
