I think this might be because the law refers to manufacturers and private labelers, and many definitions of "manufacturer" involve mass production, and I don't think most of us could be called private labelers, right?

So wouldn't it all hinge on how the CPSC defines "manufacturer"?

I'm actually thinking I feel ok about continuing all me one of a kind work.

Anyone else?

We are manufacturers. No doubt about it. And we should definitely not make any assumptions. And as of right now, there are no exemptions for OOAKs and no provisions for component testing, so in August OOAKs will be obsolete. I, personally, am keeping in mind that come February, we need a reasonable testing program in place. It does not say that it has to be end unit testing. Since there is nothing in the way I produce my items that would add any lead, I am looking into component testing right now. If everything is tested as lead-free, I am considering that a reasonable testing program. And in the meantime, I will be hoping for exemptions and/or revisions that make it possible for us to comply with OOAKs come August when the third party testing requirements are put into place.

Does anybody know what etsy's stance on this is? Are they going to stop allowing people to sell children's products? Because otherwise I plan on going right on selling my products! I just can't see the government coming after me for this. It seems to me there will be bigger fish to fry.

All vintage and antique items that were once intended for children seem to fall under this law also, even tho many of them are one of a kind and very rare, too test them would destroy them and most would never pass the new standards which is what any resell item has to pass.

My understanding is that Etsy's stance on this is that it is our responsibility to comply with all applicable laws. But Etsy will not be policing the listings and will not remove items absent a directive from the CPSC that the shop is in violation of the CPSIA. That is just my understanding, though - I may be mistaken.
