Washington, D.C. – The U.S. Consumer Product Safety Commission voted unanimously
(2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.
The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.

This is amazing news! Thanks so much to everyone who poured their hearts and souls into this. We can't give up the fight, but we certainly have some breathing room. I can't wait to go "fabric shopping" this weekend! Yeah!

Finally someone in the government is using common sense!!! I am happy to hear some good news, but the fact that the CPSIA has gotten this far to begin with makes me wonder if this is a way to slip something past us while we are out celebrating.

I have lovely friends, a retired couple that make doll beds and blankets and sell them in craft shows. This was their dignity. It paid their real estate taxes and heated their home. They were in tears as this started to unfold not knowing what to do except become minimum wage workers somewhere.

My sentiments too. KathleenF mentioned we can start selling again at the end of March, 2009, under this stay but does that mean no selling of untested items from February 10 until then?

While good news, CPSIA has totally paralyzed my production plans & caused the loss of so much time & money.

Don't quit working for a permanent rewrite of this badly written law. Sen. Demint's proposed changes look promising. Would like to see the fine print in it, too.

This is exactly what I have been hoping and praying for. A postponement just made sense to me. Perhaps now they can add some people to their committee, take some time to study what is written in this law, and make some wise decisions on this law.

Even more importantly, Congress can now focus its attention of some of the dire issues facing our country. We need to get this economy on a better track. They need to work on unemployment, ideas for creating more jobs, and get some stability into the American way of life. And end our wars!!!

As a side note, I think it will certainly lift that gray cloud hanging over our creative heads and allow us to create with enjoyment and pleasure as we used to do.

Indeed. The news is a tremendous relief, but this is no time for complacency. It's imperative to keep the pressure on, and to stay informed on developments. Without practical and realistic amendments, we'll all be back in the same sinking boat this time next year. Keep blogging and getting the word out! (I know I will.)
