CPSC Clarifies Requirements???

Ok... help me out here.

Per the CPSC Clarifies Requirements of New Children’s Product Safety Laws Taking Effect in February
Guidance Intended for Resellers of Children’s Products, Thrift and Consignment Stores

The new law requires that domestic manufacturers and importers certify that children’s products MADE AFTER(KEY WORDS) February 10 meet all the new safety standards and the lead ban.

Sew your butts off before Feb 10!!!!!!!

Sellers of used children’s products, such as thrift stores and CONSIGNMENT(KEY WORD) stores, are NOT required to certify that those products meet the new lead limits, phthalates standard or new toy standards.

OK I now run a CONSIGNMENT STORE....


The new safety law does NOT(KEY WORD)) require RESELLERS (KEY WORD) to test children’s products in inventory for compliance with the lead limit before they are sold.

However, resellers cannot sell children’s products that exceed the lead limit and therefore SHOULD AVOID (KEY WORDS) products that ARE LIKELY(KEY WORDS)to have lead content, UNLESS (KEY WORD) they have testing or other INFORMATION (KEY WORD) to indicate the products being sold have less than the new limit. Those resellers that do sell products in violation of the new limits could face civil and/or criminal penalties.

The way I understand this is...I can sell what I have in stock but be carefull what you sell for if it contains the lead content and you get caught then you can be punished. Or should I just have documents from my suppliers as to the lead contents in this merchandise.

According to what I am reading there are a lot of loop holes. So is this new guidance contradicting the new law?

see i have read those sames sentences - and when i mailed it to my son, he said the same thing that if things are donated then i am safe - and that i should start taking "donations" so if someone donates hats to me i can sell them - b/c to my knowledge their is no lead in yarn.

Resellers, Consignment stories etc are the only ones that have been given a little bit of relief. But you still make sure whatever you are selling meet lead requirments. It is up to you to decide how you want to make sure it is safe.

The rest of us are still screwed. We MUST 3rd party test after August.

yeah I suppose you could suck on the stuff and see if you die (evil but wry grin). I don't see relief here for small manufacturers. Yet... I think that if the reach of this law, once tested, is as onerous as it sounds to be, it will be amended.

I have received documents from my suppliers in which I have placed in a binder as to there testings. This is the information I have started.

Keywords there. This only applies to thrift stores, consignment shops, and selling of used, secondhand goods. This doesn't apply to us.

I also make childrens product...try to read between the lines is what I am saying... There are loop holes.

Um...isn't Etsy against resellers? The whole thing is pretty weird and backwards. It's the feeling I have for most of what our government does. Instead of addressing the REAL issue they blanket it all and put a band aid. You know toys aren't supposed to have lead in them now and yet somehow someway they still do apparently. You know what kid doesn't put mom and dad's stuff in their mouth at some point.

The problem is that this doesn't even help thrift stores much.

I forget where I read it but someone put it so clearly. It's like telling your kids they don't have to brush their teeth but it you catch them with bad breath, they're in trouble.

Thrift stores might not have to test but they are not allowed to sell things containing lead. The only way for them to know for sure is to test.

Maybe I'm dense but I'm not seeing this as a loophole for even the thrift and consignment shops.

WE are in a better position to comply with that sort of thing than thrift shops are. At least we can know where our materials come from. Thrifts have no control over what comes into their shop.

So.... if I am understanding this... can I just give my items to someone to sell for me??? I totally understand it not fixing the problem, but could I do it until we are able to get the law fixed??

Or... if I had my daughter wear or use everything, would it then be secondhand?!?!? :)

Like i posted before...I make childrens products as well. I am all for no lead in childrens products also.

If you make your own product you are a manufacture.

I was simply saying if the product is made before Feb 10 does not have to meet requirements. With that being said I am very careful about our childrens products we manufacture as well as I am sure all of you are.

Okay - Now I'm confused. I'm sure this question is answered somewhere else, but I'm still confused. (scratching head)

I make kids art smocks from 100% cotton and linen thrifted blouses from my local thrift shop. If I make a bazillion of them before 2/10, I can sell them but if not, I can't - even though they are made from thrift-shop materials?

This whole thing is confusing...so that is why I am NOT throwing in the towel. I guess it is how different people read the new law...I am mearly tring to break it down with there own words. How do you read this new requirement?

I have been sewing all day. we have a resale shop that also sells new handmade and she said I can put my stuff in there and she will get 30% I havent sold there before but I was in there and people were selling outfits for like 50 bucks and they were not even the quality I make their stuff had raw edges and uneven seams so if the boutiques cant sell my stuff I will have a place.

I'm reading this particular guideline as only applying to secondhand goods.

The law itself clearly states that it is retroactive...everything on store shelves must be in compliance on Feb 10.

I don't think this guideline cancels that out since they are only addressing secondhand goods here.

I'm truly not trying to burst your bubble. I just don't think you apply anything in that guideline to your business unless you're selling used goods.

DaLynns, that is not true. EVERYTHING made on, before or after Feb 10th must be in compliance. Plus everything else you stated is for resellers, thrift store and consignment owners so it doesn't apply to us Etsy sellers.
