I am reeling at the new CPSIA regulations, and feel a part of this pool that has to consider closing down shop because of unrealistic expectations for lead testing.

Any one know if ART PRINT and PAPER GOODS for children (but not for the USE of children) are included in this? the paper goods and stationery industry could be slashed in half over this if this is the case. Haven't found any info online about this.

Any info you know of?

are you shaking in your shoes as I am?

Re: ART PRINTS and CPSIA

I don't think any of us who make prints expect they will actually be "given" to children. So they can what, play with them and put them in their mouths? Although there's no saying what some people do... but I suspect that the law is more concerned with little girls kissing their Jonas Brothers mass-produced posters they buy at Walmart and so on. It's just another case of government being too big for it's britches and not really paying attention to the laws they are passing.

I have read in other posts that there are lawmakers out there trying to get this law clarified for small toymakers, etc. Hopefully they will be able to do so. In the meantime, I honestly don't know if some sort of disclaimer will suffice or not.
Anyone know a business lawyer they can ask?

Re: ART PRINTS and CPSIA

No disclaimer will matter. We cannot put "Not for children under 13" either.

I tried to get an estimate for my cotton rag and 8 inks and was told by the testing place that they don't test print. Apparently they were told print wasn't included. By whom I have no idea.

I'm very tempted to just change directions and stop offering prints that might be seen as marketed to children 12 and under. It's sounding like less of a headache.

Re: ART PRINTS and CPSIA

I know a friend who has a brother who has a wife that is a clerk for an attorney who is also a politician. I'll check with my friend to see if he can find out the correct legal/political interpretation for us. That should clear it up for us.

Re: ART PRINTS and CPSIA

Don't you know that kids can absorb lead just by looking at prints hanging on walls? I thought everyone knew that???

I guess it's a good thing I've never really made birthday cards meant for kids. Wouldn't want to put them at risk for the 2 seconds they will hold the card before ripping into the present.

Sigh......

Re: ART PRINTS and CPSIA

My facetious point being ... nobody has a definitive answer for every possibility. Some things are obvious (to some people). Others are so vague that attorneys will be able to argue all day and still not be in agreement.

Re: ART PRINTS and CPSIA

Maybe we should develop a vaccine against lead poisoning. Then we won't have to worry about it, and can make anything we want.

Or, we could require all children to wear protective gloves. Wear protective glasses that repels rays from dangerous items. And, wear protective screens over their mouths so that no dangerous objects can be inserted ... only liquid food can be sucked through approved straws.

Re: ART PRINTS and CPSIA

Maybe the bureaucrats who came up with all these regulations have ingested too much lead themselves; their brains aren't working right.

So they should be voted out of office, and all future politicians should be tested before they can run for any office. In fact we should test all current politicians and the results are retroactive ... if they fail the tests they can be removed from office.

Re: ART PRINTS and CPSIA

ArtisticallySpeaking.. I couldnt agree more. I think we just need to wrap our kids in lead tested bubble wrap from head to toe.. lead tested helmets.. and never ever let them out of their lead tested rooms.

I mean, look at all of our parents and grandparents! There was lead EVERYWHERE and they are just so... wait.. hmm.. nevermind ;) hehe
