use of LEGO (R) word mark

Does anyone know the proper way to give attribution to the maker of LEGO products? I don't want to get in trouble with Etsy or the makers of LEGO, but I also want to use LEGO in my item titles/descriptions since that is what they are made of. Does anyone know the right way to do this? Any help is appreciated.

Thanks!

Re: use of LEGO (R) word mark

To answer your question regarding Lego products. You are not allowed to make products for sale from Lego bricks. You risk getting them on your case. Lego bricks are ment for what Lego invented them for, not for other people to produce their own products for sale.
You risk the following:
Having Lego on your case
having your shop closed down
Lego - and other people and companies own their product, their name and so on and so forth. The minute you use it, for whatever purpose, without having a written and signed agreement from the original owner of the product, you are committing infringement, and that can be a costly affair for you.

Re: use of LEGO (R) word mark

I had the lego legal team contact me a couple of times a few months ago, and they're apparently fine with it as long as you don't put "lego" in the title, put every reference to lego as LEGO® and have a disclaimer on your listing. A couple of my listings were deactivated at first, but once I implemented these changes, I haven't heard from the legal guys and my listings have been allowed to run. Hope this helps :)

Re: use of LEGO (R) word mark

I'm the same as Jemma, I had a listing deactivated and an email from LEGO. You absolutely HAVE to have this disclaimer in any listing that has Lego items in it:

"LEGO®, the LEGO logo, DUPLO®, BIONICLE®, MINDSTORMS®, the BELVILLE, KNIGHTS’ KINGDOM and EXO-FORCE logos, the Brick and Knob configurations and the Minifigure are trademarks of the LEGO Group of companies, which does not sponsor, authorize or endorse this site."

And this is also from the email: "There are a few problems with your listing, but the good news is that they’re all easy to fix. First, your title, “Lego Christmas Tree cards”, shouldn’t contain the LEGO term, as it’s a trademark owned by the LEGO Group. You may use a generic term instead of the LEGO word mark (i.e. “Building Block Christmas Tree Cards”), but be careful not to use another person or company’s trademark."

The lawyer was actually really helpful and nice :)

Re: use of LEGO (R) word mark

Hi I just got an email saying that lego deactivated my listing. I do have the word lego in the title so that is probably why. Should I contact the LEGO department via the email supplied by etsy? Or should I just leave it and make a new listing using the trademark symbol? Thanks

Re: use of LEGO (R) word mark

Thanks for the question and comments, I've been looking for the answer to this question for ages now and it's great to hear that your experiences with Lego have been positive.

I'm most probably going to be revising all my listings now, but for anyone who has revised their listings because of these restrictions, have you found that removing Lego from the title of your listings has had a negative impact on views or sales?

Re: use of LEGO (R) word mark

Definitely negative. I've not sold any Lego based items since I had to change the liistings but it's better than being taken to court! I've swapped out the word Lego for 'plastic bricks'.

Also, you have to always use the phrase 'Lego bricks', not 'Lego pieces' and especially not 'Legos'!!
