J'accuse! Another shop - same designs

I am a jewelry designer and discovered another (new) shop selling almost 100% identical jewelry pieces to what I make..
One of the designs is completely original, hand drawn by me and there is no way that shop could have come up with it or borrow inspiration from somewhere..
I understand borrowing inspiration and I know that there is no copyright on design, but isn't there anything I can do?
I have contacted the shop politely and sadly received a response denying the accusations, stating it sells jewelropy for over 20 years ( could not find any FB, main Internet page- nothing about this seller to see if he's honest etc)..
Any advice would be appreciated in this upsetting situation..
Thx

You will do experiment: add a new product in your shop and wait when another seller add same item

Re: J'accuse! Another shop - same designs

I've had several of my designs stolen. It really sucks. Your pieces are lovely, but I have seen some very similar pieces in other shops both on etsy and retail. Are they copying your items exactly as they appear or are there very slight variations? Unfortunately, we don't have much legal recourse if there is even the slightest change in design as I have found out numerous times. As for the item you designed, I would look into getting a copyright for it. If it's a 100% original design/image/logo and if you have proof that it was created and posted before their's then you may have some legal recourse there. Provided there isn't an issue of their shop being in a different country then yours. International copyright is a whole other ball of wax.

When did the other shop open? When were their listings posted? Do they have a brick and mortar store? It's terrible to confront someone about this kind of stuff especially when they react illogically. Bogdan's suggestion may be worth looking into. And, if there are using your photos without your permission, you certainly have a right to legal recourse. I do know that's copyright infringement. Best of luck.

Re: J'accuse! Another shop - same designs

Hi, thanks a lot for the responses!
In total 5 designs were copied, two of them 100% original designs, one of them also original but they changed it and the other two I have also seen other shops sell (although I didn't copy it, just simple geometrical designs)..
This copycat opened in late March, and I opened several months before..the day after I wrote this person another design was listed.. It seems like they took my best selling items as well as other people's designs as I recognize them from different deferent shops..
No photos or descriptions were copied however I noticed the same tags and similar titles.
It is a very upsetting situation since it is currently a slow month and I can't compete to the prices this shop is offering ( and they have sold several of my designs in the last week) ..
The new designs I added weren't copied (yet)
Anyway, thanks for your advice it is very much appreciated!
Best
