Hey everyone,
I've been facing some serious issues with my shop lately. Over the past few months, I've added several new products, all of which I own the copyrights to. But in the last few days, I've been hit with multiple malicious complaints using fake copyright numbers. As a result, all of my listings have been taken down.
This is really frustrating and it's affecting my business badly. I've tried filing appeals, but the process takes too long. Even contacting Etsy customer service hasn't helped me get my listings back quickly. I really need help!!!
Does anyone else have experience with this kind of thing? Any advice on how to handle it would be greatly appreciated!
Thanks, Adrian
I just took a quick look at your shop. I see some reviews where the listing is no longer available. If these are the ones taken down, I'm wondering if it's because the actual stockings look like you bought them and are then adding the names. While Etsy-legal for handmade, if the site you buy from is using the same photo, the bots could be the problem.
Copyright can be fought. If you believe you are in the right, you can file a counter-claim. The other party then has to take you to court. After 10 days, you can relist. Etsy must take down the listings when they get a claim and you have to fight it out with the other party. I would suggest consulting a lawyer.
If you do relist when allowed, I would use completely different photos.
Which are the items you own copyrights to? Are these the ones that are being taken down? I'm not seeing anything that could/would be copyrighted...........
@SilverstreamEmporium: "... but the process takes too long ..." Unfortunately the applicable laws are very specific about the timelines for each step. Have you read the information at https://help.etsy.com/hc/en-us/articles/360040496854-How-to-File-a-DMCA-Counter-Notice?segment=selli... ?
On etsy - or most places, etsy, you don't need a copyright number to issue a dcma takedown,
and copyright is for pictures, not designs
.... what was the actual takedown, was it IP - design?
...
I also looked at other things you put names on - they say made by you
If you are only putting names on, and not making them from scratch, they should be "sourced by"
