Someone stole my listing

Another shop has stole 1 of my listings.  I know its my listing because they have my business card in the picture.  It appears they went into my reviews and took several pictures of my product and have it listed as their own.  What should I do other than reach out to Etsy and wait.  I have been on the platform since 2017 and have never run across this issue.  My main concern is I don't want any backlash for someone ordering and not getting their product.  Any advise is appreciated.

File an official DMCA via the Etsy IP Reporting Portal!  I don’t see any business card in any of your listing photos!  Furthermore you need to remove the offending shop name from your post … calling out another Etsy seller is against Etsy TOU!

Re: Someone stole my listing

I don't have my business card in my pictures but I send out a card with every order.  Some of the reviews have the card and the note that I send out in the picture.  So this shop has taken pictures from my reviews and listed it as their own.  I was just looking at the IP reporting portal and they are asking for specific laws that this shop is breaking, I have no idea what law specifically.

@SandlotWoodworks

If they have copied photos of your buyers, from their reviews, you can't issue a dcma takedown, as they are not your photos

you can only ask for takedown, of photos you took

the buyers who took the photos, are the only ones that can issue a takedown

.......

you can go to their shop, and - report this shop, and say they are using your buyers review photos,
and go to the listing, and report their listing for the same thing
but not sure how well that will work

Re: Someone stole my listing

I would report it via the 'report this item to Etsy' link (not via the IP Reporting Portal) as suggested above. It may not get taken down as quickly but if Etsy get enough reports about the shop in question then they can investigate. It's likely the thief is running some kind of scam (e.g. Credit card fraud). There have been similar questions posted on the forum lately.

Also check the reviews of the shop - are they negative? Watch out for multiple orders in your shop for that item, by the same buyer but posting to different addresses (this is not necessarily an indication of a scam but coupled with the image theft it is worth reporting).
