Message Response Rate unfairly penalised

I received a message from a buyer that she had not received an item.  I tried on 3 occasions to reply and also tried to message the buyer via the completed sale, but was prevented from doing so because either the buyer was no longer a member or didn't exist.  I therefore refunded the buyer and cancelled the sale, land leaving a message in the notification.

I have now been penalised for not responding to the message within 24 hours, which I feel is unjust.

If you mark it as spam, it shouldn't count against you.
