Listings were removed due to "Creativity Standard Violation"

Jump to solution

I've recently had three of my bestselling listings deactivated by Etsy for violating their creativity policy, and I have to say, it's incredibly disheartening and it's taking a huge toll on my mental health. These listings were up for over a year and became bestsellers for months, only to be flagged suddenly. Having bestsellers on etsy feels like a curse at times. Thieves are quick to copy designs, and I've seen my work stolen on platforms like Temu, Shein, Alibaba, and even TikTok. It's become impossible to send DMCAs to all of them because as soon as one shop goes down, another pops up.

I've also noticed an unsettling spike in direct traffic from unknown sources recently, which seems to have impacted my conversion rates, making me wonder if there's something more going on. I messaged Etsy support yesterday, and while they said they would escalate it, I’m not overly hopeful given how things have played out so far.

I’m considering sending screenshots of my photoshop files (which show creation dates) to prove that I am the original artist. I’m also thinking of having my lawyer draft cease and desist letters to target these copycat websites. Then send a copy to etsy? Has anyone had success with these approaches?

Right now, my biggest concern is that other listings might get taken down, especially since I have more bestsellers in my niche. It’s frustrating to see thieves copying my designs on so many platforms, and Etsy’s reliance on bots left me feeling vulnerable. I wish there was more focus on protecting sellers.

Any advice or similar experiences would be greatly appreciated!

there are quite a few extra things now in standards,

1. etsy says you have to have  policies, you sell to the EU/UK, you need to have 30 day return policies for made to order

2. you need shop policies - your address and e-mail address in sellers details for everyone to see, and a gdpr policy

etsy legal policy on selling to eu/uk (note, custom is NOT made to order)

https://www.etsy.com/legal/policy/selling-to-eu-and-uk-buyers/239965962014

.....

your items say designed by, but you don't have an about section with your production partner/s listed, (and you need to link he listings to the production partners you setup)

etsy info on setting up production partners and being transparent

https://help.etsy.com/hc/en-us/articles/360000336547-Working-with-Production-Partners-on-Etsy?segmen...

those will get you flagged alone.

...

whether anyone has stolen your images too, or you are using slogans copyrighted by anyone else, I have no idea, but the top ones can be fixed quite quickly

Thanks for your input! I'll edit them now.

When i create listings i have my production partners checked on each of them so i'm not sure why this isn't showing up anymore. I guess i'll have to double-check everything.

Regarding copyrights and trademark, i always make sure that none of the slogans and tags i use are trademarked. I check them daily on USPTO.

@PrideForAllKinds

the production partners need to be in the about section too. see the link above on how-to

USPTO is for trademark, and patents only, not copyright

most countries you don' even have to register copyright, it exists for you, if you used it first

Your Production Partners names do not need to be in the About Section.

We require sellers using production assistance to transparently share this information on the applicable listings. Buyers can see information about any production partners you work with from your shop’s About section.

Production partners need to be in the about section, you don't actually have to have their name, you can say "mug printer" but they have to be there.

There weren't any at all before, now they have added one.

I scrolled through your shop quick, and your Kamala listings may be a problem, as well as the shirt with Jodie Foster's faces on it. Etsy has policies on intellectual property - and violating that would fall under their recently overhauled creative standards policy.

Read this: https://www.etsy.com/legal/ip/

Thanks for your input!

The one with the pics of Jodie was just a sample of a personalized item but i understand. I'll modify them now.
