Listing Question - Item Flaged (email states don't edit) but Item listing says update required

I made a custom order for a customer to paint a pair of Nike shoes. My guess is that it got flaged because I had Nike in the title so I got an email stating my listing was flaged and under review.

But when I look at the inactive listing the thumbnail has a little red oval over it that says "update required". And when I mouse over it it says "Before this listing can renew, you'll need to make some quick updates to shipping settings that help calculate estimated delivery dates for shoppers.".

So I don't know if I should update it or not.

I wouldn't do anything. I believe you can't use Nike unless it's vintage. And you also have other trademarks not allowed. Rick and Morty and the Air force are trademarked.

ShoeFuryByMSCHF   Before listing anything else, I would research what can be sold on Etsy (or any other venue). You can sell generic sneakers with your own design. And unless you do them yourself, you are required to add a production partner (who prints them). Many new sellers think because everyone else is doing it, it's OK. They just haven't been caught yet. And another infringement can cause shops to be closed permanently.

If the email from Etsy specifically says "don't edit" I would follow that instruction.  You cannot sell Name brand products which you have decorated, it is against Etsy rules, and also violates the original creators' Intellectual Property rights and Trademark laws.

If the email gives contact details for the TM owner, you must deal directly with them if you want to list the items, as only they can instruct Etsy to reinstate the listing.  When it comes to Nike, that is not going to happen, as Nike specifically prohibits the modification and resale of their shoes.

You may see others doing the same thing, but just like speeding drivers or shoplifters, some get away with it for a short time, but in the end they all get caught.  IP Infringement puts your shop, your stock, your earnings, and in some cases, all your assets, in jeopardy.  You need to use your creativity to come up with your own products, trading on the IP of others is not a sound foundation for a business.  It is only a matter of time until the axe falls.

Pretty sure Nike said they weren't going to allow people to sell their sneakers customized anymore (think it was after some guy was putting drops of blood in them?). Anyway, even if they do allow it, you normally have to sell them on your own site, you can't sell them here on Etsy. I have a custom apparel business I run as my day job. Nike (clothing) is one of the brands I can buy from my wholesalers. It states in their rules that I can sell customized Nike products on my own standalone website, but I'm not allowed to sell the same items on 3rd party selling sites like Etsy, Ebay, or Amazon. And here, even if you're bypassing the rules set by Nike by paying retail for them to begin with, Etsy can still kick them off as they're considered counterfeit (as Nike has not approved the designs, for example putting a sports team like the Raiders on them without proper licensing).
