Hobby or business?

I have had my Etsy shop for a couple years now and have sold at some local bazaars and have made a little bit of money. However, I'm not sure if I need to get a business license. At what point does a hobby become a business? I have read the 9 factors the IRS uses to determine if it's a business. I answered yes to 6 of them. So maybe that's my answer. Am I overthinking this? Any advice would be much appreciated.

Thanks!

Re: Hobby or business?

It depends on your local laws. I've recently found out that to sell anything you should have a business licence, just to CYA. I was under the impression that as long as you didn't make over a certain amount you didn't need one, this is mostly for federal. Some local laws say that even if you're having a yard sale or lemonade stand more than twice in a year, you have to have a business licence and collect taxes. You're running a business out of your home, so you should probably contact your local Chamber of Commerce just to be safe.

I thought there was a dollar amount too. I will check with my Chamber of Commerce. Thank you!
