still in trouble...

I guess I am still not safe from this new law. I use paint and other surface coatings (permanent markers) to make my dolls' faces and there is no stay for me.

How do I set up shop to sell to the rest of the world excluding USA. Could Etsy make a special shipping category for that?

Bummed out... I loved selling to American customers... I am American myself, but live in Norway.

I really can't, but that was a good idea. If I embroider I would have to increase the price. Plus, each doll is one of a kind. I have them made, take the photos and then list them. I can't then change the face for American buyers.

Can you prove that the markers you are using meet the new lead regulations? The law says that you can use manufactures testing to prove your product is safe.

I thought the law said you had to have third party testing irrespective of whether or not your suppliers have already tested or not?

"Everywhere else, except USA"

How do I set shipping options now so that Americans can't purchase my dolls??????

you set up shipping for all the countries you do ship to except for the US and do not use the Everywhere Else option

do you know anyone doing XRF testing? I'm shipping some samples to Michigan to be tested. If you want more info you are welcome to convo me, I don't know if a shipment from Norway would make it on time though for the scheduled testing.

You could just stop shipping to the USA maybe?

do your products fall under the ban mentioned above? if not then you are in the same boat as the rest of us. you don't have to have certification you just need to ensure your products are lead free (ie. use paint that is "certified lead free").

The stay also does not apply to children's metal jewelry or the small parts rules. Basically, anything for which they've promulgated a final rule is not affected by the stay.

Ravenhill,I posted this in another thread earlier today. Hope it will help!...


Here's my view...right or wrong. :)

I will continue to create artwork for anyone, children or adult. My paints are water based, non-toxic and lead free. According to 16 CFR 1303.3, Artists Paints are exempt. The stay does not apply to lead paints. They need to comply with the new levels and be tested.

If I find that I am wrong, I'll remove my children's designs once again and carry on.

Ravenhill--your dolls are fabulous. So fabulous, in fact, that I would not let my little girl play with one if I were lucky enough to have one! :) Can you just issue a disclaimer on your site, something to the effect of: "for all sales to the US, due to federal regulation, dolls are for decorative purposes only and not intended for use as a toy for children under 12 years of age?"
That would be my advice, but I am not too terribly informed on the idiosyncrasies of the act...

Ravenhill; your shop does not mention that your product is for children. I LOVE your dolls and would buy one just to have it. I don't get this law. What if I sell something to an adult that hasn't been tested and a child touches it? I don't know if you should worry about it. It seems to be aimed at products that only children would play with. How can you draw a straight line? Your dolls, and other items on Etsy are works of art. A child may touch it but, I don't know. It's just too fuzzy I think.
