don't get it..

what is this CPSIA stuff all about?

we take american apparel shirts and onesies and sew on appliques. does this CPSIA only apply if we take out or go over american apparel labels with our own?

You will need to add your own label. There are several threads telling you what you need and giving ideas for how to make the labels or you could order them. Several sellers on Etsy make them.

This CPSIA stuff concerns you if make or alter any product intended for children ages 12 and under, you need to read the links below to start. In it you will find important information and other links to give you information straight from the CPSC.

First of all, you can go to the CPSC & CPSIA websites and add yourself to their email lists so that you will get all the updated information directly to your email. This is very helpful, as the CPSC issues new statements and guidelines quite often. You won't have to search for the answers because they come directly to your email!

As for leaving the American Apparel labels on, I would at least until the stay of testing expires on Feb 10th 2010. That label "may" act as your proof of compliancy since metal and plastic snaps are not expressly on the exemption list. Velcro has not been offically excused at this point either though some other shops here have been told, but not in writing, by either the manufacturers or clerk at the CPSIA that it is exempt. I would also keep any corespondance from the blank manufacturer as addition proof of lead and phthalate levels if they are willing to provide the info in writing.
You will need to add your own style of permanant label, either as a second sew on tag or long lasting iron on to statisfy the permanant tracking label for items made after Aug 14th, 2009.

Please read this on the other labeling requirements that have been in affect for years. You must be following these also. There is a section on labeling of blanks you purchase to embellish or modify. These are Federal trade commission rules, and are in addition to the CPSIA labeling

I also applique American Apparel clothing. Yes, you do have to add labels on your clothing to be in line with CPSIA requirements. You also need to read the link that FayeMalone posted above regarding content and care labeling requirements.

I had labels made from an etsy seller that I will sew over the American Apparel tags on my t-shirts (American Apparel is ok with that) and my content and care instructions (which are also required) are printed on the back of my hang tags.

FINLEYANDOLIVER... do you just have your name on the tags you sew over the amer. apparel tags? and what "content" do you have on the hang tags, i get the care instructions part.

so what if i leave american apparel's tag on. and i just add my tag over it but you could lift my tag up to see all there existing info.

would that comply with FTC, CPSA, CPSIA?

all this is crazy... so much to understand!!! and i am so confused.

Please read this about relabeling when you use blanks from another manufacturer. If also has info for unsed/recycled and remnant fabrics. These are other labeling laws that you must adhere to. These predate the CPSIA laws.

OliveJuice, the labels I sew in include:

My shop name
city, state, USA
and I will hand write in the date I make each item.

The content and care instructions on the back of my hang tags state:
100% cotton exclusive of ornamentation
Machine wash cold
Tumble dry low

One more thing OliveJuice, you can download CPSC certificates on each specific item from the American Apparel website if you need them.
