The words diaper and cake shouldn't ever go together. It would be nice if we could all agree on a different name for... those things.

If the products that go into making the diaper cake are ultimately going to be used on or worn by a baby/infant then yes each component needs to have testing paperwork on file with the person selling the diapercake.

if the items are store bought then they should already have the appropriate tags.

Have you ever thought about making your diaper cakes with items from other Etsy sellers? That would be a cake I would love to have a my shower, one with all hand made items, except for the diapers of course, unless you did a cloth diaper cake anyways.

Unfortunately, they may have proper tags, but, the government sees you as the manufacturer even though you are just assembling them into a finished diaper cake.

You might want to take a picture of your diaper cakes, send them with a list of products you assemble together and ask them (the CPSC)directly for an answer.

made out of disposable diapers, its really cute a friend of mine make them, I got a wreath made for my DIL when she went into the hospital to have my granddaughter, it often has a toy and blankets with it

I was told you have to have a business license and register your business name when you dealing with items pertaining to kids and infants. I hope this helps

Diaper cakes make GREAT gifts for the mom to be. I have used burp cloths from other Etsy shops into my cakes. I think its great when several stores can benefit from one item.

I can personally make many of my own items for a diaper cake, but at the moment I am a little confused about all the laws out there.
I made my first diaper cake for a friends baby shower (I had never heard of them until another friend had told me about them) I couldn't see paying for a premade one when I could make one for cheaper.
Now I am nervous about making anything for children and babies until I can understand what is involved with all these laws.

I have the exact opposite effect. The phrase makes me gag. Really.

The idea seems cool, but the words together are utterly revolting to me. So much so, I would never buy one. :-( *hint hint* for someone out there to come up with a catch new name and style for them.

Back on topic--I've read that since they are intended for use by the adult parents, the consensus seems to be that they do not need to be CPSIA approved. I could be wrong, though.

Actually, they aren't going to be used by the adult. They have a limited usage as a centerpiece, but the contents are used by or on the child.

This is from the final ruling on what is a child's product. I think this would apply.

9. Marketing with Other Products – § 1200.2(c)(2)(iii)(Formerly § 1500.92(c)(2)(iii)). Proposed § 1500.92(c)(2)(iii) would state that the product’s association or marketing in conjunction with nonchildren’s products may not be determinative as to whether the product is a children’s product. For example, packaging and selling a stuffed animal with a candle would not preclude a determination that the stuffed animal is a children’s product since stuffed animals are commonly recognized as being primarily intended for children. (Comment 9) - One commenter states that stuffed animals sold with adult products should be considered general use items since the manufacturer intended the product for distribution to adults.
(Response 9) - We disagree with the commenter. Packaging of toys or other articles appropriate for children along with adult products occurs occasionally. Therefore, we will not assume that all products in a copackaged product are general use products if the copackaged product contains toys or other articles that are appealing to and more likely to be used by children.
