Yet another CPSIA question

I have contacted all of my suppliers & (still waiting on hearing from 2 more) they have told me that their products are non toxic, phthalate free & lead free. With the exception of the swarovski crystals that I do know contain lead, but the amount is safe.
Do I need to be redundant in testing already tested products?

According to the CPSIA...yes, you need to test them again after you make them into something if you want to sell it.

According to the current law-yes. It is a hope that supplier certified testing will be allowed at some point.

I just don't understand if I buy tested supplies, why retest if the items do not change during production other than being placed on a wire?

I want to do everything safely & legally, but stand to loose alot of time & money if I stop selling my childrens line. As do so many of us here on Etsy. It is really upsetting.

I do a majority of my shopping here for gifts for my girls. I love buying handmade unique items that you can't find in stores. It kills me that a majority of these shops will be closing due to the new laws. Plus, then I will have to buy from the big toy distributers, who are the reason for all this mess in the 1st place.

I also do not understand this law! If you do a special order for someone, one of a kind, say you just change the color everytime, does it have to be tested, since I will make only one. I have read here that you do not, but than again you do!

All of my childrens bracelets are one of a kind. I also read somewhere that you are still allowed to sell in your own state just not interstate. I find I have read so many things I don't know which ones to beleive.

Why retest? Because our government believes in alchemy. If you arrange lead free materials in just the right mystic pattern, they will generate lead!

heysista ... just a heads up. While Swarovski maybe allowed by the CA lead in jewelry law, under 1 gram for children's and unlimited for adults, there's a good chance it will not pass the CPSIA total lead content testing. The lead oxidized glass that makes Swarovski so desirable is still 21% lead which in government speak translates to 210,000 ppm of lead or 350 X the limit allowed in Feb 2009, 700 X the limit allowed Aug 2009, and 2100 X the limit allowed Aug 2012. The CPSIA is not distinguishing accessable lead or lead able to leech out from a product from total lead content, they will simple put the product components in beakers of acid to dissolve it down to whatever lead there is, and even if 1 component fails the lead level testing then the entire piece will fail. So even though other legal entities deem Swarovski safe the CPSIA probably will not, since they are looking at the total lead by weight rather than if the lead can even come out of the the glass matrix without complex chemical reaction.
So, you know as jewelry makers we may be able to use, at least until March 23rd, 2009 the general conformity certificates issued or MSDS Sheets by our suppliers regarding our designs as our reasonable testing method, but not a general lead free statement. After March 23rd we will need to have 3rd party testing regardless if the suppliers have already tested the components.

Common sense says we shouldn't have to retest in that situation, but that isn't how the law is written. What you are describing is component testing and this isn't allowed as of right now. That's what kunklebaby is saying in her post and we are hoping will eventually be one of the changes that's made to this law!
