Would this be considered a child's item?

Would a diaper bag with changing pad be considered a child's item or an adults with the new laws? I would like to put one button, but I am trying to determine if this is ok.

I think it would be considered a childs item. You will have to follow the new CPSIA laws.

Err on the side of caution. When in doubt, assume you come under CPSIA.

A diaper bag alone would be for the parents use, but once you add the changing pad it becomes a child's product since it now aids in the care of, the feeding of or the sleeping of a child under the age of 6. Even if the bag and diaper pad are made of products exempt from the lead testing such as non-metalic and non-plastic treated fabric with no notions or embellishment it still would have to be submited a materially identical set, if you sell it that way, for at least phthalate testing and possible other tests. The exemption list is strictly for exemption from lead testing not any other subsection of the CPSIA law, including the use & abuse testing for products intend for children under the age of 3, of the small parts warning labels for products for children 6 & under.

So anything for kids has to be tested no matter what? I thought that if you made something with fabric such as kids clothing you didn't have to do any testing. This is terrible.

Any item intended to be used by or for children is subject to the laws. I remember a video of someone not on etsy who was going out of business because she couldn't test her vinyl bags intended for clothes a kid pees on.

Fabric is exempt from testing, but it does need a proper label, which you can find examples of in the forum.

Fabric and the other raw supplies on the list are exempt from the lead testing, but certain product catergories need other tests under the CPSIA. Which of the other tests will depend on what the final product is and what age the government deems as the miminal allowable age for such a product. The best thing to do is goto the main CPSC page, http://www.cpsc.gov/index.html , type the common mname of your product(s) in the search area to see what comes up. Then goto http://www.cpsc.gov/businfo/reg.html and click on the 1st letter of the common name to see if additional links come up.

Since it is a diaper bag, under CPSIA it would be 'housing' the diapers, changing pads etc... and would come those items would come in contact with the child. So it would have to be in compliance with CPSIA standards.

This makes me wonder if my nursing covers are under this law as well. It's so confusing and time consuming it's ridiculous.

All good advice. I was unaware of the new rule since I just got back into etsy. So my girls' purses do not have to be tested? They are made of recycled jeans.

The denim is exempt, but the grommets, brads, zippers and other embellishments would need to be 3rd party tested for lead. The 3rd party testing is digestive testing and will destroy the end product. Fun Huh?

I'm so confused. I have bunting made to decorate a child's room. It's made from fabric and is absolutely not meant for a child to touch or play with (for no other reason than i wouldn't give a small child a line of rope to play with)! Do i need to be testing? My fabric is vintage linen and burlap???
