What if the consumer purchases the materials???

Hello! Question for all you Etesians....what if the customer purchases the materials and commissions us to craft the item?? Does it still require testing??? I'm just trying to think outside the box....what if I don't sell products, but rather provide the "service" of sewing. Consumers could purchase the materials needed to make a nursing cover..have them sent to me and I could craft it for them.

Any ideas???

I've had customers send me special fabric they wanted made into a book or a security blanket before. I wondered the same thing. In these cases, am I a manufacturer or a service provider?

I think there are an awful lot of gray areas here.

I agree about the gray areas...we need clarification!

Another thought...what if a shop provides "kits" for certain products but the consumer is the one to "manufacturer" it for themself?

You are contracting to provide construction. You are not a manufacturer. Big legal difference, and I do this for some people. I then cover failure in quality of craftsmanship, not material. Only had one return claim from a buyer who said I sew badly. Might be right, but all I returned was my fee for services.

I've got to add on about kits. I am responsible for them because I choose the materials they are made from.

I agree that jumping through hoops is crazy, but apparently necessary :) Maybe we can join forces and shops can list fabrics and other supplies neccessary to make items...then list several other shops the customer can contact to craft the item they are wanting. Sounds crazy, I know, but if it keeps us going until the law is clarified, then why not try something outside the box to get us through???
