Above is the link to the latest CPSIA description on "What Constitutes a Children's Product". It should clarify the classification for some of you...however for some products it is very subjective. A lot of it is common sense.

Sorry, but in my humble opinion "common sense" is not now nor has it ever been a factor concerning this law...

Henry Waxman, a primary mover in the creation and enforcement of this law is up for re-election this fall....
