Velcro question

First, let me preface by saying I am an attorney. I have read all the legal speak in all of the CPSIA stuff, but I am still slightly confused. I practice criminal law where I don't have to worry about that kind of legal language as much!

I just want to verify that I am understanding the CPSIA requirements fully. If I use a velcro fastener on an item made of otherwise exempted materials, the fastener itself is not exempt. I can use the GCC from the manufacturer of the fastener as long as it is compliant. I also understand the labeling and record keeping requirements. Have I got it all?

Not all...*Velcro* is a trademarked name. It might be acceptable for use if it is actually *Velcro* brand...not a copy.

hook and loop tape is exempt. Velcro is a trademarked name of one manufacturer's hook and loop tape. It's all exempt.

If you actually do use the Velcro brand, VELCRO requires that it be listed and described as VELCRO (in capital letters) in all descriptions and mentions of the name. If it is not the brand you are not allowed to use the name but have to describe it as hook and loop tape.

Unlike any brand of hook & loop tape, buttons need testing under the CPSIA. So if you can not get your suppliers to "cough" up the properly formatted GCC or current lab test results for non-exempt supplies with the lead (& if your products need it phthalate) levels in PPM then you will need to have your supplies tested at your own expense if you choose to market, describe, or picture your items as being for children under 13.

I don't market for children for that exact reason. Nothing in our shop is directed towards children, knit or otherwise. I get requests for childrens knits and I direct them to other shops.

guess what jewelrydesignsbyME, I checked, my supplier posts all CPSIA info on their website, and it all passes CPSIA regulations with flying colors. However, my buttons are still not suitable for children as they have ADULT humor.
