Trying to come up with a "disclaimer"

I am trying to come up with a disclaimer to put in any listings I might have that "might" be purchased for use by a child under 12 - mostly in my other shop "ilovevintagestuff"

I am thinking about adding to every listing I have that could possibly be purchased for someone 12 or under

"This product is NOT intended for use by anyone 12 years old or younger"

Think that would work?

A disclaimer is not a loophole, the CPSIA has stated this. If the CPSIA determines that your items would be appealing and appear to be marketed toward children 12 or younger then you are required to comply with the law. If your items walk that very fine line of clearly being intended for those over 12, but there is a small chance someone may buy one for a child, then you would be fine using a disclaimer.

In the case that a disclaimer would apply to your shop, a very simple, to the point statement should be all that is needed.

I have this listed in my shop policies:

Due to CPSC and CPSIA regulations, nothing in this shop is intended for use by children under the age of 13. For more information on this law, please see the Consumer Product Safety Commission's website, at http://www.cpsc.gov.

Along with the fact that I don't market my items to children, I think I'll be OK.

Current Situation

No lead added to yarns or fabrics
by U.S. Textile Industry

Testing of incoming fibers and fabrics
reveal none or only trace levels

Even if trace amounts of lead existed, very little or none would remain on finished fabrics because:

Low application levels

Washed out during processing

I am confident that all my products are perfectly safe and hopeful that the mess that is CPSIA will be repealed or significantly amended soon.

(Doesn't help with compliance, I know, but shows why CPSIA-mandated testing of textiles is unnecessary.)

I realize that I could not use this disclaimer on something like the Crayon Roll Ups in my grannyscloset shop.

However, in my ilovevintagestuff shop there are some pieces of jewelry there that one might buy for a child - like a rhinestone elephant pin or a scottie dog pin. These are "iffy" items and I am wondering if the disclaimer would be ok in that kind of instance.
