This is new to me

I realize there's probably been tons of post asking the same thing, but...

I've been out of the etsy loop here for a bit and this whole CPSIA thing is new to me as of tonight's browsing of the forums.

I understand it's for products geared towards children 12 and under. I don't market products for children, but since I don't have a firm grasp on what this is all about could somebody tell me if I should be worrying about this with the products in my shop?

The items in your shop are very cute. The way I understand the law is that if it is marketed to, intended for, or appeals to (that is the kicker one) children 12 and under, then it has to be labeled beginning in August and then beginning in Feb. 2010, you will have to test the products. Hopefully this law will be amended because the appeals to thing makes it to where the government can make it apply to almost anything. For example, I make blankets, but even if I make one adult size and make it with sports fabric and intend it for adults, high school or college kids, it could still appeal to a 12 year old and therefore I would have to label and test it. That is why I will probably be closing my shop soon unfortunately unless the law somehow gets amended.

What is a children's product?


A children’s product is one designed or intended primarily for children 12 years of age or younger. Toys, clothes, furniture, books, jewelry, blankets, games, CDs/DVDs, strollers, and footwear may all be considered children’s products.



In determining whether a consumer product is “intended primarily” for a child 12 years of age or younger, the following factors will be considered:



A statement by the manufacturer about the intended use of the product, including a label on the product, if such statement is reasonable.


Whether the product is represented in its packaging, display, promotion or advertising as appropriate for use by children 12 years of age or younger.


Whether the product is commonly recognized by consumers as being intended for use by a child 12 years of age or younger.


The Age Determination Guidelines (pdf) issued by Commission staff.

If a product is intended for adults or for general use by consumers of all ages, then it is not intended primarily for children. Products marketed and priced in a manner that would not make them appropriate for use by a child would also not be intended primarily for children. An example would be an expensive telescope -- because it is sold for general use by all ages, it is not a children’s product even though it can be used by a child on occasion.

Ya, there's no "appeals" that I've seen written in the law. I'm not sure where that's coming from.

As I said on another board, if it came down to what "appeals" to children, they'd have to test everything *but* the toys. My youngest's favorite toy is my cell (and he already knows how to consistently hang up on my mom!) My oldest prefers knives. (This one is scary and requires constant monitoring.)

Oh, as far as your shop, my guess would be that you don't need to worry, unless you start making cases with juvenile fabric and tagging them for kids. Right now your stuff looks pretty general market.

Hey guys! thanks for the responses. I'm going to go get that pdf too. wow, this is confusing stuff. I feel really bad for all the crafters making kid oriented items :( This is a lot to take in.

Helpful comments.
I hope they never make the law if it appeals to children.
What if a child wants a toy in a happy meal that is not 3 or over? Are they going to make McDonalds quit making happy meals?
That job is up to the parent or caregiver.

This is very confusing. My items are not toys or intended to be toys, but, they are very whimsical. Miniatures and Ornaments. Made of polymer clay. Does anyone have any advice as to how this would affect my shop? Thank you in advance. :o) button

I hate how general the laws have to be to make sure that they get every single instance in there. Honestly, the US needs to make up its mind...either legislate to protect children in which case they need to sign the Convention on the Rights of the Child or stay the hell out of it.

The law does not say that. Please reread my post on page 1. It's from the CPSIA guide to the consumer product safety improvement act for Small Businesses, resellers, crafters and charities.
