Regulatory Flexibilty Act - Look what I just found the CPSC's strategy

Okay, I just found this.

I know there is the big issue of the CPSC not doing the RFA study of the impact on small businesses, and I find this very interesting.

Go down to the part titled IMPACT ON SMALL BUSINESS


IMPACT ON SMALL BUSINESSES

Section 605 of the Regulatory Flexibility Act, read it.

The number of small businesses that will be directly affected by the rule is unknown but could be considerable. However, because the effect of the proposed rule would be to relieve the manufactueres and importers of the specified materials from the testing and certification requirements the CPSIA, it will not result in any increase in the costs of production for any firm. Its only effect on businesses, including small businesses will be to reduce the costs that would have been associated with testing the specified materials. Consequently, the Commission could certify that this action will not have a significant economic impact on a substantial number of small entities under the criteria of the Regulatory Flexibility Act.

What they are saying was the *changes* they were proposing wouldn't have a negative impact, not that the CPSIA wouldn't.

I think they were saying the "changes" wouldn't have a negative impact on the manufacturers of the components since they would not have to test them, only the people who use the components in a completed item would have to test (us) and they never even thought that might have an impact. I don't understand when someone can't see that "A" may not have consequences for "B" but may affect "C" or .....

I consider myself to be fairly intellegent. I can talk to my doctor and understand a lot of the medical jargon. However, I cannot understand an iota of what these people are saying. Just when I think something is clear, they interject something that contradicts it.

Just please once. Speak to us in plain English. Do I have to test if I'm making an item that is unlikely to have lead in it. No, you don't have to test. Thank you very much. Quit the mumbo jumbo of reseller, thrift, blah, blah, blah.

I'm about ready to call myself a retailer, because I'm purchasing thread and fabric and reselling them. Who cares that I'm altering it.

This clause is referring to the impact on the proposed changes to CPSIA that will exclude natural materials - and not on the original CPSIA. The statement is true - allowing the use of natural materials without the need to test them will lower costs to business (no cost of testing) and this is a valid and positive statement.

Find the Impact on Small Businesses clause in the original CPSIA. So far I can't - and that is the issue!
