Question about Overkill on Disclaimers.

I have put a disclaimer on my shop announcement page and I have put a disclaimer on each and every piece of jewelry on my site.

There are no disclaimer on my supplies or images and since the t-shirts are meant for adults I didn't bother with the disclaimer for them either.

Is that consider overkill to put the disclaimer on each individual item or would it be enough to just have the disclaimer on just my shop announcement page and my policy page?

I could use some insight into this matter. Thanks for your help ahead of time.

JMO here but it may not seem like so much over kill if it said "***" as opposed to "DISCLAIMER"

I think it would be just fine to have it in all place, then someone would have a harder time saying "I didn't see that."

I have finished changing my disclaimer notices to: Please Note: Our products are intended for adults and consumers over the ages of 12 years old, Thank you.

I really hope these words work better, I had noticed slower sales after putting up my original disclaimer.

And I have still kept the "Please Note" on each of the individual jewelry items.

I have read repeatedly, however, that disclaimers won't help if something happens. :(

I have a disclaimer on my shop announcement, too, just in case.

CPSIA is specific in that a disclaimer means nothing. There are charts at CPSC that categorize items by age. If you are selling something that falls into one of those categories and are not do the necessary testing, labeling, etc. then you could be found in violation of the law.

If it was only so easy as to use a disclaimer - as is permitted by other laws - but not in CPSIA.

No, of course not in CPSIA! It's for the good of all, after all! *eye roll to emphasize my sarcasm*

I'm leaving my disclaimer up, because I do NOT make items for children, so my hope is that it will discourage people from buying my items for their kids. Some of my designs are whimsical, but my items are FOR grown-ups.

This law is written very clearly that a disclaimer is not considered valid.
If the powers that be decide your item is intended for children 12 years and younger and they do not comply with the law, you can be arrested, fined and jailed without warning.
The whistle blower aspect of this law means a competitor can give your name as a violator without you even knowing who it was....
The only thing you can do to protect yourself is to make sure none of your items would be appropriate for children 12 or under.
All the Disclaimers you can think of are useless...

I don't think I have much that is appropriate for a kiddling younger than 12...but I still have the disclaimer on my policy page, and mention it in any of the recycled copper works...I've had a few expecting mothers worry about wearing somthing while they are preggers. For me it isn't the law as much as it is giving options to my customers.
