Can I sell kids' hot/cold rice packs without an FTC label? They have a removable, washable cover, but these aren't large items (5 x 5 inches). Where would I put two labels on those covers without them looking really strange?
I think I've found someone who will make me 100% cotton labels reasonably, but TWO labels would probably mean I'd just have to stop selling the items. This is getting ridiculous.
MeowWow, Check with the FDA if they consider the hot/cold pack to be under their prevue as a medical device. If they do feel that your products belong under there regulations then you MAY not have to have the CPSIA testing & tracking labels. It's possible that the labeling requirements may be different for the FTC since it's medical device and may interfer with the function or the product.
Is it permissible to print the tags using printer ink or pen ink? If it is attached to the toy would that then have to be tested? I've looked through various threads and pamphlets but I can't seem to find that information anywhere... Just that there need to be tags!
Melanie, yes the tag must be permanantly affixed prior to 3rd party laboratory testing so that it is counted towards the total weight of the product if the product's or label's raw materials are not on the exempt material list. Now if you use totally exempt materials like a fabric for the tag and print the fabric in an ink jet printer with a CMYK cartridge inks those materials are exempt and no testing is needed if attached to a product made of 100% exempt raw materials. Sorry no official word about magic markers, luandry pens, or standard pen inks.
Thank you all for all the information! I'm having a question... My products are made for babies / toddlers, how can I make sure that the perent won't remove my sew on tags?! I'm asking becouse I'm having a child with a SPD and all of those tages are a big issue for him... I allways need to remove them...
bouji- once the item is purchased, the customer can remove any tags. could you make iron-on transfers and apply them directly to your items (like the "tagless t's" from hanes)? that way they'd be stationary but not irritating. i get that- i have spd too. tags are mean! :)
greenvanillababy, You're so right! Tags are mean to us! Thanks! I this it will be a problem to iron a tag on most of my items... I have spd too... but it's worst with my son... About bumpers and blankets - need to tag them this way too?
