Interesting that this comes just as Obama is announcing proposed new chairman and director of CPSC. It will be interesting to see how this plays out - as I suspect if these new members are confirmed all stays and exemptions will be withdrawn.

That would be good news since they still haven't made up their minds. Pastperfect, just curious - why do you think all stays will be lifted once the new folks take over?

superflykidz, though I hate to be pessimistic, I'd tend to agree with pastperfect. While they may not actually lift the stay, unless changes are made congressionally, I would think they may allow the stays to expire in Feb '10. These are people from the groups (to include the Democratic party and consumers groups) who support the CPSIA wholeheartedly, as written. There is, of course, the chance that congressional Democrats will work with industry (including cottage, artisinal, and micro businesses) to effect some meaningful and positive revisions to the Act now that Ms. Nord has stepped down, one of their *demands*.

That said, I'm going to try to stay positive and hope that this will work out.

"Nord, appointed by President George W. Bush has a term that lasts until 2012. Though she would no longer be chairwoman, she is not being asked by Obama to leave the commission altogether. Should she remain, she would likely be the lone Republican member of the new five-member commission."

So, they will not lift the stay, but let it expire? I guess that wouldn't be bad if the stay is in effect until we have clear guidelines. We can't expect this to all go away - we can hope that it will be revised and make a little more sense in the end.....

Since they've never actually answered our questions in a "this is the absolute thing you can rely on" way, about what exactly needs to be on the label, let alone how to put a label on something small (with an unprintable surface like a hair bow!) that would fit the requirements as currently stated.

I don't know if they will let it expire or not. That was my speculation, of course, on two different paths they could take. (My favorite path would be the one where Congress wakes up, sees the error of their collective way, and scraps the Act. It's a happy little world I live in, with unicorns and rainbows and marshmallow clouds ...)

I would hope the Commission would see reason. If even to the extent that bad laws lead to people ignoring those laws (not a good precedent for a *nation of laws*). However, if Ms. Nord is indeed a scapegoat (and the lone voice of a Rep. nominee among four Dem. nominees), then she may not be heard. We'll have to wait and see how it plays out.

I think I may have to take a break from this this weekend. It's Spring (finally!), birds are singing, my garden needs work, and I have a pile of fabric to sew...

Oh -- one last thing. Mr. Woldenberg's blog entry from May 6 (http://www.learningresources.com/category/id/104652.do) is about the labelling requirements. In that article, he discusses the confirmation hearings for the two new Commission appointees and speculates about open dialogue at that time. Perhaps we should email/write the members of the governing committee (particularly those in the minority), urging them to use the hearings constructively to bring up many of these concerns. If for no other reason than to get the nominees on record with their views on specific concerns.

Hmm, maybe Jack Bauer shouldn't have let the canister of neurotoxin explode in the hazardous van, ..... If it went off in another place in DC. we would have to elect all new people. Maybe we would be smarter the next time.
