New Walmart Inventory Untested

I went into Walmart yesterday and saw new toys being put onto the shelves. These were all Spring and summer toys like things for the beach, water guns, sand toys. All were labeled Made in China and none had any indication of any testing or certificates. The same was true in the children's clothing department where new Spring clothes were being put out - no testing. Nothing was marked down so this was not a clearance. All of the shelves were being re-arranged for new inventory.

So - I will draw no conclusions but there does not seem to be any concern for CSPIA at this particular store.

This is not to say that we should not still be concerned, but I have a feeling this is going to be ignored at all levels.

They may have all the cerificates and just not be posting them. They're not necessary until the 10th - they may be waiting like eveyone else.

I read in one of the 5 million articles about cpasia that walmart and all the big retailers have known about the coming of this law and have been preparing for it since last May.

I'd read that Walmart was refusing shipments of merchandise that wasn't CPSIA compliant - I don't think they need to display the certs, just have them.

I'm sure all the Chinese manufacturers digitally filed their certificates with WalMart and they are in some internal Walmart database right now.

Don't you feel safer about the products you buy there now? Hahahahahaha.

Things don't have to be labeled until August. Retailers may have the GCCs on file and don't have to display.

Ummm--nothing HAS to be tested unless it is made on or after 10 feb. Nothing has to be certified till sept 09. They can keep the items on the shelf, untested, till certification is required.

I think inventory has to be compliant as of Feb. 10 (reasonable testing and GCC) and 3rd party testing and permanent labeling is August.

Once upon a time, the mighty Wal-Mart was only going to sell items make in the USA. I still have a jacket I bought there in the early 90's that was made in this country. I should hold on to it because it could very well be a collector's item someday!

My pet peeve the store that is selling out America.

They are probably either dumping excess inventory or relying on a court injunction backed by their lobbyists and army of lawyers.

The law is retroactive so procuts must be compliant with the new laws even if it was in stock / manufactured prior to Feb 10. There are conflicting reports and even snopes has it wrong but you can read more about how retailers are affected here...

It is explicitly stated in the law that it takes effect on Feb 10th and that it is RETROACTIVE meaning everything currently on shelves either needs to be tested or thrown away. Labelling and third party testing are not needed until August. No company in their right mind would be accepting shipments that will in less than a month be considered hazardous material.

That said, W-mart does not need to display their testing efforts. They have been well aware of this law for nearly a year and I am sure that they have all of their ducks in a row and have had the required certificate information on hand for many months.

That's not true. Everything has to be tested for lead. on Feb 10, regardless of manufacturing date. (The phthalates test in not retroactive but the lead is.) Everything has to be certified by a "reasonable testing protocol" by Feb 10 and by a third party testing firm by Aug 10. Where did you get Sept. ?
