Another problem with the letter Waxman wrote to the Commission condemning them for not fixing the mess he and Rush created in the bill they wrote:
When the Commission HAS acted, Congress and others have undermined their efforts.
In a letter issued November 17th the Commission said that their reading of the bill indicated that products untested for Phthalates could not be manufactured after February tenth, but *inventory could still be sold* and did not have to go to the landfills.
http://lawprofessors.typepad.com/products_liability/files/cpsia__1.09_.pdfIn comes Barbara Boxer, Democrat from California, who wrote this provision. She said the Commission was guilty of a gross misrepresentation of the bill ('blatantly incorrect') and it was her intent to make it retroactive and clear out inventory of businesses and force them to dump those products.
On NOvember 4th, the Natural Resources and Defense Council and Public Citizen Filed a Complaint AGAINST the CPSC demanding that inventory NOT BE PERMITTED to be sold after February 10th.
So everybody is angry at the Commission and complaining about their 'failure' to act in a timely fashion, while Barbara Boxer, Waxman, Rush, and company undermine them from within, refuse to help them, and undo any of their efforts to alleviate the damage this bill does to businesses (without a corresponding increase in safety)- and they get away with it.
THAT'S why the letter ETSY Admin posted here, the one written to Waxman insisting that he needs to hold a conference and allow Congress to work on fixing this bill is SO important, and is the most useful stance yet from Congress.
