Estys stand on February 9????

What does etsy have planned for 2/9/09. Are we all suppose to shut down our shops, pull all childrens items? Wait until we are shut down, what do we do?

I hadn't planned on shutting down but the more I read, the more I wonder. This is what I do for a full time living and now I am starting to panic a little.

I was wondering that with both ebay and etsy.
Seems they both stand to lose a very substantial amount of money due to this horrible law.

That is a great question! I have just had an awesome week and so I keep listing and to be shut down before my inventory is depleted. Any news from admin on this yet? Bumping up...

It's in Etsy's terms of use that you, as the owner of your store, adhere and follow all laws. They are just the venue. So, if YOU break the law by selling it's not Etsy's problem....it's sort of like patent infringement. If the patent holder complains Etsy will shut you down.....if just someone in the general population flags you, I don't imagine they will do anything.

Ozarknana, so as of 2/9/09 if we are still open and selling then we will be breaking the law? I don't mean to seem simple but I have read some of the CPSIA documents and evidently you have to have a law degree to understand what they mean.

Taken from Etsy's TOS, it appears that regardless of what country you reside in you will not be able to sell on Etsy as they state items that are considered hazardous in the USA (which children's items will be considered) are not allowed for sale on Etsy.

Etsy Admin needs to clarify this for sure.

On 2/9/09, we're golden. But, 2/10/09, we're illegal. Technically, the third-party certification only begins in August, so if you can come up with a "reasonable testing program" for your items, then you're okay. But, no one really knows what "reasonable testing program" includes (e.g. it seems "reasonable" to not have to test items that have no inherent risk to them, but that's not going to fly; some folks are trying to get things tested with XRF guns, but those things are crazy expensive too).

But, yeah, I think Ozarknana is right. Etsy would say it's up to us to comply with the law and won't force us to shut down. However, as disheartening and depressing as it is, I've seen more than one seller insinuate they'd be willing to turn in other shops for non-compliance b/c they feel crappy about having to close their own.

yah i'm not sure if i'm going to have to close shop or what... i'm also thought about just doing other crafts. i crochet so i could sell other items. I really don't know what to do!!

That's a heck of a note, especially from someone else who is trying to make a living at handmade. There has to be some truth in bad karma.
