That is a request from the manufacturers. I ran a search on the Federal Register (2009), and the CPSIA stay from last friday didn't come up. It may not have officially come before the CPSC yet. The whole thing should be repealed.

The stay is in effect until February 2010, but this article from overlawyered.com also points out how the people who pushed the law into place in the first place are already fighting to have the stay removed:

Also, even though there is a stay, manufacturers and sellers are still required to sell items that don't exceed the decided lead amount - they are just not required to test them. Does that make sense? You can also go to CPSC's website and read their statement about the stay. It's 17 pages long, but you can skim through it and it helps explain things. It also helps to have a lawyer husband who knows all the legal talk. :)

This is a new stay that still needs to be voted on. It will postpone the Feb 10th effective date for 6 months. Extremely important piece of information to help retailers that are still requiring testing.

I read it to mean that they are requesting a stay on lowering the lead limits. That is what section 101 (a) (2) concerns.
