Don't ask, don't tell.

That is my new policy. It seems to be a popular sentiment with my local retailers as well. I have a few possible wholesale B&M accounts who are fully aware of this law. They have no intention of complying. I feel pretty much the same way. I have researched the hell out of testing methods that would make my OOAK pieces compliant, but in the end, not one makes fiscal sense for my business model. Not to mention that if I am trying to comply, what statement am I making? I'm done picking apart this law, looking for a loophole. I'm done with hanging on to shreds of hope that this law may be changed. I'm not saying that I've become apathetic... far from it. I will fight this law every day until it is repealed or changed beyond recognition. But I WILL NOT OBEY. I won't even give it a college try. Come and get me.

NICE, I just hope it doesn't hurt our business, I hope buyers aren't going to start thinking we are selling lead to them, I know a lot of people i tell this to are like acting like this is a huge deal and that lead is in clothes and they have hurt the kids by buying stuff before the law. errr, it's silly, we have put this fear in the country thinking that our children are poisoned. blah. Crap my brother dyed of brain cancer at 29 does that mean he had been exposed to lead in his clothes, we are all doomed if this is true. but what else is killing us, EVERYTHING!

I agree... yep. I take a ball of yarn and turn it into a hat. Nothing else is added. Just the yarn and now it needs to be tested?? This law is ridiculous!! (And my spelling might be too)

Good for you, Lillipopdesigns! I really hate to see anyone close their shop until this whole mess gets straightened out. I have some vintage dolls I'm going to put up for sale that aren't even really for kids anymore but for adult collectors. If the CSPA has a problem with that...too bad!

Maybe Civil Disobedience will make a come back, and it is about time, things have gotten totally out of hand! I do not believe this law is about anyones safety, not anymore, it is about money...as only large manufacturers could possibly comply with it.

And if they are going to enforce this law...and if it states anything that could be construed as being used by a child...what about cell phones? Kids use them all the time!

All electronics have been put on the exempt list in the proposed changes. They know that they have lead in them but "it can't be helped". So your kids can get lead poisoning from known sources such as computers, video games, and cell phones, but not from toys and crafts made from non-toxic materials.

such good points.

but, if the typical etsy shopper was shopping here before, doesn't it seem likely that they're a little out of mainstream anyway and not as likely to take to heart all the media hype (and i mean out of mainstream in a very good way <3)

besides, we can all just have an online shopping commune and only buy from each other :)

Civil Disobedience rocks! :-) I have a statement in my shop policies that I found on the CPSC website from the National Textile Association, stating that textiles (fabric, yarn, etc) do NOT contain lead. As far as I'm concerned that's good enough for me. Our products are no more dangerous now than they were before this idiotic law was passed.

Even before the commission made it extremely clear that they have neither the means nor the motivation to go after small businesses for noncompliance, I was thinking, yeah, right... on February 10th the friggin FBI is going to come crashing into everyone's living rooms, ripping the yarn out of their hands, and dragging them off to prison!!

Um, they have MUCH bigger fish to fry.

There is absolutely no money to make from prosecuting us, and absolutely no money to spend on prosecuting us.

It won't happen.

I will continue my business as before. Muslin cloth dolls have not hurt children yet and they wont start now no matter what the oxygen deprived in DC say!

Remember law suits are winnable ....I got the down payment for my house cos I got fired by some dingbat who felt it was hard for her to watch a disabled person work....
